hey,

I need some help with reference to filing the I864 and I864a forms.

My wife is a new grad out of college and has a job lined up as soon as she passes state boards etc. Therefore right now she has no income and her mom has agreed to be a sponsor for us so that I can go ahead and file my forms. Now does my wife fill out I864 and then her mom fills out I864a? Or do they both fill out a I 864? And then on I 864 part 1 does my wife check box "A"saying she is the petitioner or does she check box "D" saying she is the only joint sponsor or does she check box "e" saying that she is the first or second joint sponsor?

I would appreciate any help because I need to file these forms soon.

also her mom is married and files jointly so do we need to claim 3 people as the household, me, my wife and her mom or do we need to file for 4 and include her dad?

Wife must file I-864. If wife lives with mom then mom can file I-864A. Otherwise, mom must also file I-864.

Wife is petitioner - she check's box "a". If mom files I-864A then make sure wife includes mom's income in section 24.b of wife's I-864. If mom files I-864 then wife doesn't need to include mom's income on wife's I-864.

Dad is included in mom's household size, but mom doesn't include dad's income on her I-864 unless dad signs an I-864A.

Let me know if any of this doesn't make any sense or you need more details. The form instructions actually make this stuff pretty clear, but you have to read them completely.

ok we are about to move out house in like a week so I will file forms after we move so that I have new address. So mom will file I864, and what box does mom check, only joint sponsor one?

correct,

she is the only joint sponsor
