What is going on? Can she really adjust her status?

Hello again my fellow vj members,

As i have asked ur help for a friend of mine who came here on a tourist visa and married her USC boyfriend who is her husband now. When she married her bf her marriage in the Philippines was not finalized yet.

She adjusted her status in December last year and up to now she still did not get any extension letter or her green card.

She is starting to worry. Do u think it is possible for her to have her status adjusted after marrying on a tourist visa?

Is this the bigamist? Do you mean to say her divorce/annulment was not finalized in the PI yet before she married her husband?

If you mean her divorce in the Philippines was not final when she married her BF then it is possible her AOS will be denied as her marriage is not valid. Under US law you cannot marry someone if you are still legally married to another person, even if the paperwork to dissolve the marriage is in the process.

Possible outcomes? 1. Her AOS is approved and she receives her green card. For the remainder of her life as a US resident or citizen she will live under the cloud that if USCIS ever discovers her marriage was not legal her green card/citizenship could be revoked and she could be deported. 2. Her AOS is denied and she is found guilty of material misrepresentation and/or bigamy. 3. Her AOS is denied and she is permitted to legally marry her BF and refile.

Not sure. In the second thread the OP stated that their "friend" did end up getting their green card. These might be two different but very similar cases.

Maybe, or the person lied about the approval to get us off their backs (which I believe because a bigamist shouldn't be able to get a GC - USCIS must be able to check simple records in foreign countries). It seems too similar to me... same country, same method of entry to US (tourist visa) same issue with no annulment. Both are "friends" of the OP.

While the friends may be getting away with it for now. At some point, it is going to blow up in their faces. Perhaps, when the friend tries to petition for her child from the first marriage.

Both spouses of the invalid marriage are in big trouble for signing immigration forms with a material misrepresentation.

The whole process if difficult at best and not cheap, why make it harder than it needs to be.

Here is her previous topic on the matter. I also remember a multiple page one which maybe has been deleted because of lying on paperwork. You told us that your friend was approved, but I guess that was a lie. I am happy the system works.

Hello fellow members,..these situations i have been asking questions about are 2 different persons.

1. Was married to a black man with 2 kids and is already a legal resident eventhough she married her husband now while she was still married in the Philippines. She has her 10 yr green card but could not file for her citizenship and she wants to bring her daughter from the Philippines here. (she's here in GA)

2.The second person came here multiple times on a tourist visa and finally married her bf here(she has 3 kids in the Phils- no kids with her husband now) while on a tourist visa still and marriage in the Phils. was not finalized yet at the time of marriage. She filed AOS last year and still no extension letter or approval and no green card either. She is in Texas now.

I understand that the other post was deleted because iknow for a fact she committed immigration fraud and the reason why i asked is because i wanna know if what i told her was right.

I have no intention to post here for people to get confused.If the post needs to be deleted then i would understand.
