Friend in Desperate and Needs Help

Hello fellow members,

I am asking again ur help for a good friend of mine.

To cut the story short,,her USC husband has a child with his previous wife. Husband is unemployed for 3.5 years now and still no luck in finding a job.

My friend is not working since she got here coz she has two young twins.They are both depending on the husband's parents to survive.

Because her husband was not able to pay child support ,,the license was suspended and cud not have a way to get a job now.

The ex wife took the 5 yr old son to another state without his permission .

here are her concerns:

1 what is the option they can have in order to at least get his license back?

2.what about his ex who took the child out of state without his permission? in the divorce decree they have joint custody but didnt say about taking the child to another state.

The parents can not financially help them pay the child support which now amount to more than 3k.

I wud appreciate ur help.thanks in advance.

Timeline

They need a family law attorney to help them. Someone who knows all the facts and the has access to the divorce decree. Anyone else is just guessing.

2.what about his ex who took the child out of state without his permission? in the divorce decree they have joint custody but didnt say about taking the child to another state. File a kidnapping report with the police. Sue the ex-wife in family court in the new state that she has established residency for custody of the child.

The parents can not financially help them pay the child support which now amount to more than 3k.

In some states interfering with a parents visitation rights is a crime.

Nobody can tell you much about that part because the Child Custody Order in the divorce should put limitations on such things or at least list requirements for making such moves. Violating this agreement isn't criminal but a civil matter.

Regarding the Child Support, her should have gone in to court a long time ago to seek a reduction in the amount to be paid (generally can't be done retroactively) due to his change in income (being unemployed).

thank u so much for all ur replies. Who should go to the court for child support reduction? the ex wife or the husband who is paying child support eventhough unemployed?
