Ankitc, if you don't mind, give the following details. We will try to find what could be NVC is looking for.

  1. Did you get one RFE or two!
  2. Have sent IRS Tax Transcripts or copy Full tax return! If full return, does it contain your MIL's W-2!
  3. What amount did you enter in item 23, 24 a, 24 b & 25 (2010, 2009 & 2008)!
  4. What is the amount in 1 (Wages, tips...) of your FIL's W-2!

Yeah, I am starting to get confused on what I should put there.

I also read on another forum that the person used a joint sponsor and used only 1 of the person's incomes to qualify as the joint sponsor on the joint return and sent no W-2's or anything and was approved...

Yeah, I am starting to get confused on what I should put there.

I also read on another forum that the person used a joint sponsor and used only 1 of the person's incomes to qualify as the joint sponsor on the joint return and sent no W-2's or anything and was approved...

We can't go by that - the affidavit for birth certificate was done wrong (DD/MM became MM/DD and those are just a number apart) and know one noticed it and I got my H-4 back in 1998.

Let's see Ankitc's details to figure out what amounts need to be entered in 24 a.....

Ankitc, you mentioned above that your FIL entered his wages from his W-2 in Part 25. And you gave that amount to be 38,518.

But based on the information from NVC checklist provided by you (reproduced here belwo for ready reference), NVC has issue with the amount provided in Part 25 only. The amounts given in Part 25 for 2010, 2009 and 2008 did not correspond to the amounts of your FIL W-2.

"Name Of Joint Sponsor's income indicated on the I-864 Part 25 does not correspond to that

This is where the issue could be - In 1040 amount in "7 Wages..." is not always same as the amount in "37 Adjusted Gross Income". So check your FIL 10140 to see if he has these two different - probably due to Taxable interest or Divident. The AGI is not always same as the Wages from W-2.

Dave, based on Ankitc's example, your father needs to provide his own income in his I-864 and not joint income. To be safe, I would include mother also and submit her I-864A. Why don't you call/ email NVC and inquire! Generally they respond to emails in 2 - 3 days. I will check again this wek-end and try to get a firm answer by Monday.

Could be and I only based my remarks on the information provided.

I could have been in similar situation requiring a sponsor, had my petition been approved a month earlier, as I started working only from 6/27. I still debated using my father as sponsor (he files jointly) but refrained due to this confusion as that time (Thanks for your help at that time). Fortunately I had good 2008 and 2009 (even though it was for 7 months) and I went to Business school in 2009 and only worked in summer 2010 and has a little less than 125%. So I went on my own, as I have a good 2011 and received 3 pay stubs by the time I filed I-864.

Are schedules included in this line 22 figure?

So are we supposed to break apart the income including the schedules or not?

I understand where they get the total income from but it includes the schedules.

Total income is the figure asked for from a 1040 form. AGI, is the figure asked for from a 1040EZ. Sure, all schedules are included in line 22. So, for example, if you had $40k income from wages and a $5k loss from a part time business, your "income" is $35k.

Total income is the figure asked for from a 1040 form. AGI, is the figure asked for from a 1040EZ. Sure, all schedules are included in line 22. So, for example, if you had $40k income from wages and a $5k loss from a part time business, your "income" is $35k.

I am filing a complete return as you suggested but I am just confused as to what to enter for Dad's joint sponsor income from a joint return on the AOS.

So I know to use his W-2 Income. But we have a Schedule B where Mom ad Dad both have a joint bank account with about $2000 in Interest income. Would this be split down the middle or doe they want wages only for the i-864? I read the form instructions twice and it did not clear this up.

I gave the answer already. Take line 22 and subtract the individual income of the person not acting as sponsor. Alternatively, provide an I-864 from dad and an I-864a from mom.

Joint account income/s can be allocated to any one individual or can also be split equally - it doesn't matter. Do you have any reasons not to use your mother income also! If you don;t have one, let your mother also join using I-864A else if you have a valid reason, then use all the interest income from joint account to your father and just remove the income of your mother and use it. Let an explanation letter from your dad be attached explaning the same.

Even though My case is closed at NVC I sent an email from mine and my wife's email add to NVC regarding this issue.

Dear Sir or Madam,

I have filed i864 since I do not make enough to be able to sponsor the principal immigrant My father will going to be a joint/co-sponsor.

I live with my father and he is the head of the household and he also claims me as dependent on his tax returns

My question is, since I live at the same residence as my joint/co sponsor ( My Father ) will he have to fill out i864A or another I-864 ?

2.My dad ( the joint/co-sponsor ) is filling taxes jointly with his wife so in his tax transcript the adjust gross income is combined income of his and his wife And

Because He is filling taxes jointly The amount shown on W-2s and tax transcripts are Different So What amount should he fill in Part 6 of i864 Ques # 25 if he has to fill i864 or Part 1 of i864A Ques # 11 ? Amount from His W2 or Amount from Tax transcript ( Married filing jointly ) ?

After almost 2 days I received reply in my wife's email from NVC

"As this petition is no longer located at the NVC you must resubmit your inquiry or request, and all future correspondence to the U.S. Embassy or Consulate General noted below .......etc"

But I received proper guidance via email And it clarifies almost everything

Dear Sir/Madam:

Your inquiry has been received at the National Visa Center (NVC).

In general, the I-864A is intended for sponsors who are residing at the same address as you and are your relatives.

Question 25 of the I-864, or question 11 on I-864A should always match the adjusted gross income per the most recent tax return regardless if the taxes are filed jointly.
