Unique Situations as offered on USCIS

Hey all, on USCIS it says: If you believe your situation to be unique, explain it fully in an attachment to the packet, not as a cover letter.

Have any of you done this? Is it worthwhile to do so, or will it sound like a sob story. I would like to write about my husband's scholarship to the US, or is this more reserved for family, health and emergency specific situations?

are you asking about expedite? if so then yes its specific situations according to the expedite criteria listed on USCIS and even then they don't often grant them when needed.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

More information is needed. What kind of visa is your husband trying to obtain? What do you mean by "unique situations as offered on USCIS"?

I googled "If you believe your situation to be unique, explain it fully in an attachment to the packet, not as a cover letter." and got this page. So I'm assuming (please correct me if I'm wrong) you're trying to obtain an immigrant visa for your husband and are hoping that his scholarship to the US counts as unique situation that will expedite the visa process. Unfortunately, a scholarship is not grounds for an expedite.

More information is needed. What kind of visa is your husband trying to obtain? What do you mean by "unique situations as offered on USCIS"?

So I'm assuming (please correct me if I'm wrong) you're trying to obtain an immigrant visa for your husband and are hoping that his scholarship to the US counts as unique situation that will expedite the visa process. Yes, that is exactly what I'm talking about, my husband got a private scholarship but has to be in school not later than August 2012, i KNOW that i am probably over reacting, I just want to explore every option available, but i also don't want to piss off the USCIS by assuming my situation is unique if it isn't considered so. So thanks for the advice, we won't bother.

p.s. applying for an I-130, sending it off in less than 2 weeks when i get back to the states as I am in Spain now.

I'm sure you don't need to request an expedite when your husband is not scheduled to start with school before fall 2012. Plenty of time to get through the regular process.

Its for the later case, getting a scholarship is not a unique situation - unfortunately :)

The case could be expedited for family health issue or your spouse is in war torn region which could not be safe for him/her etc.

As most of your adviced you almost a month back start your i-130 dont wait anymore, I guess you just looking to expedite your case thru consulate, unfortunately there is nothing in your case that would qualify your case to be expedited.

i'm actually in spain and have some important documents back home, we are on on our honeymoon for the summer and just started really doing the papers, we are almost done! just a timeline of our relationship and a cover letter and we're all set, getting some pictures together along with other proof and waiting for the affidavids of support, since we cannot do direct filing i'm waiting to get back to the states and send it off pronto! did you all send your documents overnight fed ex or USPS?

I believe we had used FedEx, don’t remember. It should not matter what service you used as long as you make the package traceable. The only peace of mind is that you can trace upto the delivery point, but USCIS is notorious about losing the packets so I would not be surprised if you ever hear that they lost your packet.

Once you are back in US you should have enough time to get CR1 process.

Never been to Spain... so no clue... :)
