Kishorev1 and RICARDO4EVA2 this is the feed back from Consular Section, U.S. Embassy Georgetown from their Facebook account "You may choose to apply for a non-immigrant visa at any time. You will need to convince the interviewing officer that you will return to your home country after a short trip abroad. While you are welcome to apply, it is generally more difficult to qualify if you have a pending immigrant visa petition" anyways guys thanks again.

The biggest issue with a tourist visa is that it doesn't guarantee that the Immigration Officer at the point of entry will allow you in. You can have a valid tourist visa, but if the Officer at the airport suspects that you won't leave the country then he won't allow you in (remember, he'll see that you are pending I-130). You need to establish a job, property, and/or familial ties to your home country that are stronger than your ties to the USA. At the very least it is a BIG financial risk if a flight from your home country is expensive, as you may have to get right back on a plane back home. If you do get entry, then if your PD becomes current you'll have to go BACK to your home country for interview and processing before returning to the US, as you cannot adjust status on a tourist visa.

I've researched the following extensively, as I've tried to think of every angle to get my wife here with me, and I've verified the above with USCIS.

The biggest issue with a tourist visa is that it doesn't guarantee that the Immigration Officer at the point of entry will allow you in. You can have a valid tourist visa, but if the Officer at the airport suspects that you won't leave the country then he won't allow you in (remember, he'll see that you are pending I-130). You need to establish a job, property, and/or familial ties to your home country that are stronger than your ties to the USA. My wife comes to visit me on a tourist visa with no problems,she comes over 3 times a year and has done so for 3 years now and we have a PENDING f2a,as long as she has prove of returning home after her visit its not a problem

Its almost 5th of september and no interview letter received!!!

I think vb will be published on 9th Sep, shall we assume one month progress?

Do you think it will keep moving only one month in next vbs???? :unsure:

I think, we could now finalize the prediction. I bet for a month movement for the next VB. Let's just hope for a better November or December VB. :yes:

This is pure guestimate and hope-- no basis; I am predicting it would move to june 1st 2009 assuming the interviews would open up on sep 6th.

I didn't say it wouldn't work. I just said it could be a big financial risk, as the officer at the airport could deny entry. Also, adjustment of status from a non-immigrant category (tourist) to an immigrant category is generally denied and in some cases is considered fraud (as you DO intend to immigrate and are using a non-immigrant category to gain entry to the country). I'm not saying the laws are right or good, but that is the way it is. Feel free to ask a USCIS officer about it... I have done so twice. From the uscis.gov website: If you fail to maintain your nonimmigrant status, you may be barred from returning to and/or removed (deported) from the United States. If you entered on a non-immigrant visa and you DO intend to immigrate by filing adjustment of status then you are in the USA illegally by definition. Again, you can ask the USCIS staff about this (no need to take the word of some dude on the forums with such an important issue).

Flint35, what kind of proof did she provide? When I asked the USCIS this question they were somewhat vague, and said that a "career job", property, or stronger familial ties were the only acceptable proof. Every website and every conversation I've had with immigration officers has suggested that this was an unlikely scenario and potentially risky (both for the cost of plane tickets and the non-immgrant vs. immigrant issues mentioned above).

I'm not opposed to people trying whatever they feel is necessary. We're all free to do as we please. I'd just recommend that people analyze the risks involved and get the necessary information from a REPUTABLE source (like the USCIS), and not make decisions based on what they read on this or any other forum. We're all looking for loopholes or any way we can to see our loved ones, but we shouldn't let our desire to be together threaten the possibility of that happening.

Couple months back My wife and 7 months old boy applied for tourist visa because of attend my PHD graduation ceremony! When I filled DS160 online for them, it has question about any immigration petition previouse filed and result. So my wife simply got rejected and officer told her that they cannot issue any kind of visa until they make any decision on immigrant visa petition.

Unfortunately, Your wife has no option to get any kind of visa since immigrant visa petition still in pendings. Also have disadvantage because your wife's pregnancy.:crying:

She comes on the I94 waiver visa program,only a few countrys can use this program and the U.K is one of them...she has to have a return ticket from were she left from,proof of residencey in the U.K and last wage slip to show she is still employed in the U.K but she has never been asked to show these only the return flight home...
