I had the same question to my lawyer before I applied F2A visa.... answer from him was "they would reject tourist visa while immigrant F2A petition is pending , even if in case they for some reason they provide visiting visa it would be an issue while F2A immigrant visa is being provided... so he suggested me to not apply for tourist visa after applying immigrant visa". TOurist visa is non-immigrant intent; thats one of the reasons, why you cant apply for tourist visa while your immigrant visa petition is pending. You cannot apply for F1 (student) visa while your F2A is pending becoz of same reason. You can apply for H1B though without issues. My lawyer suggested to apply tourist visa before I could apply immigrant visa [that way we dont have conflicitng interested; but this will cause delay in PD, so I opted for F2A].

Not correct. People get approved for Student and Tourist Visas alike even with a pending case ...

Guys my wife is 19 weeks pregnant right now for our first baby and glad to know that it is a boy, her expected day of delivery is on January 2012 do you think guys im there before my wife will give birth to our first child? my PD is march 17, 2009. If my PD will not be current for the next month i will apply for a tourist visa is it possible? does it carries any burden because i have pending immigrant application?

you should apply for tourist.. you have not anything to loose. The pending immigrant visa case does carry much weight but doesnt wipe out all hopes. Dont be discouraged.. . go and out forth the effort.

hey ricardo if you are sure then ok.... but this is not my opinion what I put forward from my lawyers and also what I gained knowledge thru many firums/articles...so I doubt your thought,

Remember to also establish a voice for yourself..... and dont just do something because some lawyer said so. How do you know, it's a good news. Another thing please do not bring God in this forum. God has nothing to do with immigration process.

Patient lover if u r not receive interview by 6th, then PD will be 01/01/09.

plz dnt mind i'm disagree...... As i knw and believe Allah or God he can do everything just believe urself and believe on him if u said god has nothing to do with immigration process so how u got thoughts to filout F2A application wihout using his given mind how u paid fees without using his given money ? did u done all work wihout Allah or God ?

everything working with his permission (Raza) if he wana solve our porblems he can do it in a second just he going and say ( Kun) but he always give to us everthing step by step but some realy lukcy folks got everything before born. if somewhere i'm wrong correct me ?

Kishorev1 and RICARDO4EVA2 this is the feed back from Consular Section, U.S. Embassy Georgetown from their Facebook account "You may choose to apply for a non-immigrant visa at any time. You will need to convince the interviewing officer that you will return to your home country after a short trip abroad. While you are welcome to apply, it is generally more difficult to qualify if you have a pending immigrant visa petition" anyways guys thanks again.

anyone can apply for tourist visa even if you had pending immigrant petition, just have concrete proof or evidence that you will come back to your country. Like big business, work or anything that will forced you to comeback. I tried myself and they ask me proof and i submitted documents of my existing business but they said, No you will never comeback since your wife and daughter is in USA.
