OK...just a little panicky about stepson's timing out. He has his immigration visa and will arrive in the US a few days before his 21st birthday. Is he, therefore, safe from timing out? OR...does he have to have his actual Green Card in hand before his birthday?

Help please. Thanks.

I don't understand why his age is important, he was granted a visa. he has the visa stamped in his passport, as long as he enters the country within the 6 months of issuing the visa, he will have no problem.

there is no timing out.

there is no timing out.

The USCIS wording says "must be a permanent resident before turning 21" so that's why I asked. The visa does not constitute being a PR as I see it.

I just went through this. There is a new ruling that took effect only a month or so ago. AS LONG AS HE IS ON US SOIL BEFORE TURNING 21, HE IS OK. K2's do not age out. Period. He should file for his AOS as soon as possible however.(Assuming he is coming in as a K2)
