Anyone out there had problems with Quezon City Hall, my problem is this. My fiance was granted her anullment in May, 2011 and it had to be recorded at the province she was married in.They thought the paper work was a fraud, so they sent it back to Manila to be signed again.They have been sitting on this for 2 months, and i feel we are dead in the water.Our lawyer says he checks on it, but you know the money is already gone.Any suggestions, thanks.This site is great!

Because so many cases have been bought, so now they double check.I applaud the women that stayed single, because the anullment process in the Phils is horrible.This anullment has costs thousands$,and its very difficult standing on the sideline, waiting for this process.I guess one day it will be finished and i can apply for the K-1 visa. Being an american, its hard to phanthom the process in the Philippines.always manana', 2 years and waiting.People say we,re lucky.

what legal impediment did they told your fiancee that they found in the supporting documents forwarded to them. And yes it is true that there are annulment being bought here in the Philippines, but I think it is the duty of your lawyer and the court to attest that the decision was deemed final and legally binding. But, on your end, I guess you could tell if your case was really done in good faith or not and that the case really went through the correct legal process.

The grounds for annulment of marriage are:

1. Absence of Parental Consent. A marriage was solemnized and one or the other party was eighteen (18) years of age or over but below twenty-one (21) and consent was not given by the parents, guardian or person having substitute parental authority. The Petition of Annulment must be filed within five (5) years of having attained the age twenty-one. However, if the parties freely cohabited with the other as husband and wife after having reached the age of twenty-one (21) a Petition of Annulment can no longer be filed.

2. Mental Illness. One or the either party was of unsound mind at the moment of the marriage. But if the parties freely cohabited with each other after he or she came to reason the law prohibits the filing of a Petition.

3. Fraud. That the consent of either party was obtained by fraud, unless such party once having knowledge of the fraud freely cohabited with the other as husband and wife. The petition must be filed within five (5) of finding out the facts of the fraud.

4. That the consent of either party was obtained by force, intimidation or undue influence. Except when the same has ceased and the party filing the petition freely cohabited with the other as husband and wife. The injured party must file within five (5) years from the point in time the force, intimidation or undue influence disappeared or came to an end.

5. One or the other party was physically incapable of consummating the marriage, and such incapacity continues and appears to be incurable. The filing of the Petition of Annulment must be filed within five (5) years after the marriage.

6. Either party was at the time of marriage afflicted with a sexually-transmitted-disease (STD) found to be serious and seems to be incurable. This may also constitute fraud. The filing of the Petition of Annulment must be filed within five (5) years after the marriage.

SEPARATION: being separated from your spouse with or without communication is not grounds for annulment. It does not matter how many years you are separated. There is no law that annuls or voids a marriage automatically. Only a judge in a court of law can annul, void or nullify a marriage.

INFIDELITY: is not grounds for annulment.

This was just the first site that came up when I googled grounds for annulment.

Assuming these are the correct grounds for annulment, I would say the great majority of annulments granted are not ligitimate.

I think Malta is the only other country in the world that has no divorce.

It is possible Quezon City Hall was correct

You could just be had. If your lawyer sent in false documents he is not going to be in any hurry to tell you that he did. And he probably

isnt going to pursue it and bring more attention to himself. So the best course for him would be to leave you hanging. If your fiance'

realy fits in one of the catagories then things should work themselves out.

ground rule for annulment and any legal case is to check the credibility of your lawyer first. they represent you in court and the success and failure of the case are on their hands. How far did your fiancee know the lawyer that represented her? is he one of those who many that just do magics in annulment? I think tho, the civil registrar find some irregularities in the document or maybe there were pending cases from the said lawyer or court of illegal procedures when it comes to this. Either way, your lawyer as your legal representative should carry the burden of proof to justify the legality of the decision. As far as my annulment went, my lawyer totally helped me out on my annulment case until it had been finalized and annotated at the National Statistics Office.
