Thanks a lot.

So this is the picture:

1 - as for the tax returns:

My sponsor meets the 125% guideline if we count the gross income as the real number, and not only the W2 income.

2 - If the consular officer decides he will only consider the w2 income, I have listed on the I134 form, stocks and bonds that cover 5 times the difference of the amount missing (to meet the pov. guideline). Of course I have a copy of that fund.

So that´s for last year.

3 - As for this year, my fiancé´s been employed for 6 months in a job that says in a letter that she will make a fair amount of money annualy. Way more than what she earned last year.

I would like to hear your opinion about my situation.

rlt, I didn't personally use an I-134. What you list would be correct for an I-864, as I understand it.

rlt, I didn't personally use an I-134. What you list would be correct for an I-864, as I understand it.

meauxna, the consulate in Rio asked us to use I-134 but send us the poverty guidelines for I-864 and how to use assets as it were I-864.

I only offer advice - not even legal. Just the plain and simple kind.

Hope you can help....

I don't make the minimum to sponsor my wife on the I-130/I-864 being self-employed according to my gross income on my taxes.

But, I do get money gifts up to 10,000.00 a year from my mom out of her estate.

According to the income tax law this is non-taxable income.

Can I use this money to get me over the minimum required?

I have a notorized letter from my mom and copied the money gift law to add to my packet of stuff and copies of the cashed checks.

Curious what you think or if you have herd of someone being able to use this type of non-taxable income.
