Caterpillar To Pay EPA $2.55 Million Due To Clean Air Act Violations

The Environmental Protection Agency and Department of Justice yesterday announced that they had reached a settlement with Caterpillar, the popular construction equipment manufacturer, over Clean Air Act violations that the company allegedly committed. Caterpillar allegedly failed to report its emission controls and meet engine-labeling requirements. As a result of the settlement, Caterpillar will pay a $2.55 million fine, and both recall noncompliant engines and reduce excess emissions.

According to the EPA, Caterpillar allegedly shipped over 590,000 highway and off-road diesel engines without the correct emissions controls required by the Clean Air Act. The emission controls that the Clean Air Act requires are called after-treatment devices. After-treatment devices control the engine's exhaust in its exhaust system, like catalytic converters and diesel particulate filters, as well as the proper fuel map settings and ECU calibration. The EPA say's that, "Caterpillar allegedly shipped over 590,000 engines to vehicle assemblers without the correct [after-treatment devices] and with improperly configured fuel injector and map settings." In some cases, those engines were then put into trucks that released excess NOx into the environment.

"This settlement demonstrates our commitment to enforcing the Clean Air Act," said assistant attorney general for the Environment and Natural Resources Division of the Department of Justice, Ignacia S. Moreno. "Caterpillar will pay a substantial civil penalty for shipping engines that did not comply with these Clean Air Act requirements."

The state of California too is looking to get into the action. The California Air Resources Board, better known as CARB, is also settling with Caterpillar for engines that lacked proper after-treatment devices. California is looking to get a $510,000 settlement from Caterpillar.

PEORIA — Caterpillar Inc. announced it will build a new large engine factory in China.

The company said the plant, which will be built in Tianjin, China, will supply customers in China and Asia with engines in the 3500 series and be the third Caterpillar facility to make that series.

The 3500 series is made in Lafayette, Ind., and at a facility in India. The new plant, which will begin operations in 2013, will not affect operations at those plants, said Caterpillar spokesman Jim Dugan.

“This new plant will support the growing demand for our large engines in China and all of Asia. It’s a capacity expansion,” Dugan said.

The new $300 million plant will be Caterpillar’s largest engine facility to date in Asia Pacific, the company said.

“For years, Caterpillar customers across China have been using machinery and gen-sets powered by 3500 engines to help drive sustainable economic progress and development,” said Jiming Zhu, Caterpillar vice president for China, in a news release. “With the opening of this new engine facility in Tianjin, Caterpillar will be better positioned to compete and support its growing base of customers in China and across Asia.”

Caterpillar’s Large Engine Center in Lafayette will focus on supporting 3500 series customers outside of the Asia-Pacific region. “As such, the company does not expect the opening of the new facility in Tianjin to have an impact on current employment in Lafayette,” the release said.

“This is a long-term strategic decision to increase capacity for 3500 engines that will position Caterpillar to better meet customer demand for these engines in all regions of the world,” said Gary Stroup, Caterpillar vice president of the Large Power Systems Division.

The company did not say how many the new plant will employ. It currently has more than 7,400 employees across China.

Because the demand is elsewhere. If we were to invest in infrastructure, demand and production would increase here. But we cut demand on these shores and so the industry cuts production. It's really simple.

we can't invest in our infrastructure. There's a little government organization called the EPA that stops any realistic planning that doesn't fit with the language of the left-wing kooks out there.

You just saw it for yourself. The EPA attacking a company that the US Government and private firms rely on for building roads, bridges, etc...

How do you think that $2.55 million is going to be recouped? Higher prices, higher bids, most expensive equipment, loss of jobs, etc.

You just saw it for yourself. The EPA attacking a company that the US Government and private firms rely on for building roads, bridges, etc...

Caterpillar is going to build machines here only if they are in demand. These machines are only in demand if there is construction going on. There is close to none and there will soon be less. Demand is in Asia, that's why they open a plant there to supply that demand. Asia is investing, the US is cutting. You cut demand, you cut business expansion and you cut jobs. That's how it works. It's really, really simple.

Shame that another great company has to leave this country to make a living and take more high paying jobs along with it.

Yes, it's a shame that infrastructure investments are made in Asia creating jobs and wealth there while no such thing occurs on these shores anymore because we can't get ourselves to face the simple fact that w/o demand, there will be no business expansion and hence no jobs. No, we're actually doing all we can to get rid of whatever little demand there was left. Cut it all. And all the jobs with it.

So we need MORE government involvement? We can just buy the "Made in (Country without EPA and punitive taxes)" engines when we need them I guess.

I wonder how many people here realize that the Chinese factory is independent of the equation...

With or without environmental laws in the US, that factory would be built.

I also wonder this, are people here wanting the US to be more like China and be lax on the environment?
