Hi all - I've been reading the posts for a while but now I have a question of my own, hopefully someone can give me an answer on this.

Can my fiancee still visit me and enter the US after I submit the I-129? We are just starting the process and will mail the I-129 shortly to the Vermont center - he lives in Canada and he can pretty much come and go as often as he wants. Is he allowed to cross the border into the US while I have the I-129 pending?

I could not find this information anywhere in the guides.

In general, the answer is 'yes' that he can come while the K-1 is processing. But bare in mind that he could get turned away at the border just as he could during any visit, at the disgression of the boarder control officer. He should make sure to have documentary evidence to prove 'strong ties' to his country of origin (Canada) and that he has reasons to go back.

Somewhat, it seems like an 'at your own risk' sort of thing. Be prepared if he does get turned back. It would probably be safer for you to visit him if that is a possible alternative.

Welcome to VJ!!! Hope to hear from you from time to time. There's a wealth of information here and soon you'll be answering questions, instead of asking them.

I visited the U.S. many times by car (I'm Canadian) during our I-129F processing. They would sometimes ask me for proof of ties to Canada, such as my mortgage/lease documents, most recent pay stubs, most recent utility bills, etc. As long as you are honest with them, and tell them you are just visiting your fiance, and have proof of ties to Canada, your chances of getting let in are much better.
