Hello Guys,

I came in USA on 07 October,2001 on F1 Visa.In 2004 i changed it to H1b1 with a company who messed my life.they got bankrupt and i became out of status.the I94 on h1b1 has expiry date October,2007.The Company Proved a fake company from new jersey and they were busted later.they mess up my life.I have two Ms degrees in CS.On July 28,2011 i got married with my girl friend whom i was dating from last one year.She changed her name with mine name.Now she is moved in same apartment where i am living from two years.I want to know what i should have to do now.I have to file my papers right away or i have to wait more.My family back have not met me from last 10 years and they are too much worried about me.Please Guide me about how to change my status and i can start living a normal better life and can earn god money.Also I have added her to my personal bank account which i have from more than 4 years.I have only tax paper which were file in 2005.I have not got any deportation letter from uscis.

You are adjusting from a Work visa not a family visa.

So firstly you're in overstay and based on your dates you'll be subject to a 10 year ban _if_ you leave the US. Luckily for you the overstay can be "forgiven" if you adjust your status on the basis of marriage to a citizen.

Read the guides on filing I-130 and I-485.

Very important DO NOT LEAVE THE COUNTRY!! DO NOT APPLY FOR ADVANCE PAROLE, you can't use it!!! USCIS will be happy to issue it but if you use it and leave YOU'LL TRIGGER THE 10 YEAR BAN. The ban will be enforced by CBP when you try to re-enter.

If you're careful, once you have your green card in hand then, and only then, can you travel freely.

Thank you very much all of you guys who are helping me here. I really appreciate it.once again thank you all.I met with an attorney this is What she said " I cannot file I 30 and I 485 together.I have to file first I-30.When it will approved then i can file the I 485 application and work authorization".Please let me know about this what you guys think

The attorney is wrong. Please read the instructions for I-130/I-485 CONCURRENT filing on the I-485 instructions.

yes it is saying i can apply all the document all together.What should i have to do now.weather i have to file all paper work together or separate.need suggestions.Also weather i have to hire the lawyer or i don't need her.

I already suggested together. CONCURRENT means together. If you are having trouble understanding what I am saying then it may be best to hire a lawyer.
