HCMC Post-Interview: White slip after Blue slip?

Hi, My wife got the interview at HCMC (Ho Chi Minh City) in Saigon in July 1. She was given a Blue slip asking for info from the petitioner (me) such as "report details about how relationship, residency in the last 10 yrs, info about ex-spouse" and from my wife info about her "residency in the last 10 yrs".

She was asked to submit these reports on July 29 at 1pm. After waiting until 4:30pm, she was given a "White" slip with note saying in Vietnamese but similar to this translation "your case still need additional procedures. N additional document or info is required from you. We'll contact you when the additional procedures are done. If you have any question, contact hcmcinfo@state.gov or via letter".

What does that "white" slip mean? What is my situation? what could or should I do? Is there anything I could do? etc..

It sounds like you are in AP (Additional Processing). This can take a few weeks to several months.

-1.. not denial so dont let it get you more frustrated than you already are. That link is not the same thing as you got...

Welcome to the HCMC world of AP... take a moment and read through the pinned AP topic in the VN regional... There is likely some issue that the consular Officer has with your case and they want time to investigate the relationship and or documentation submitted.. This could take a few weeks or several months... sometimes well over a year... there is usually nothing that can be done to speed things up... a visit to the consulate sometimes yields results but only when the CO is present to talk with the person inquiring or if something is submitted that they needed to get past the issue. An inquiry by a congressional rep can let the CO know that you are serious about the petition, but it cant make a difference on the actually speed of preocessing or 'make' the CO do anything.

We had photos of our wedding ceremony and banquet at Park Royal Hotel in HCMC, Thailand trip before wedding, Honeymoon trip after wedding, a couple of get-away trips, and a family trip for a cousin's proposed wedding plan 4 hours drive from HCMC.

My wife told me the CO never looked at any photo or evidence during the interview on July 1, then issued a Blue slip requesting "notarized" reports on relationship, my residency, ex-spouse info. She then submitted these along with pictures as my Report on Relationship referred to them for each timeline. Don't know if they looked at the photos or read the reports at all, but given her a White slip late in the afternoon.

Even though the note never said explicitly about denial, but are we in such situation?

What if anything we could do? Should I refile the I-130 as some suggested? or contact Marc Ellis for help??

how long have you known your wife? you've been a long time VJ member but seems you didn't do your homework and was unprepared with the docs for the interview. usually after you submit the timeline/residency they issue pink. hopefully they just need more time to sort out your ex etc.

since the CO didn't look at any pics or evidence it does give the notion that they generally have blue or pink in mind going in...and the interview just reinforces it one way or another. are there any potential red flags that you can think of?

as scott said if you're not physically in vietnam the best thing you can do is contact your congressman for an official inquiry into the petition.

The issue is the ex spouse... that is the common cause for AP... Dont be surprised if they contact the ex... or do a visit to your spouses family to check everything... Marc will likley tell you the same thing we are... not alot that can be done... other than wait... and have your congressman do a status inquiry... filing a new petition will not make the issue that they have with the case go away... so that would just be wasted money and energy,

The case is not denied until they say it is being sent back to the states... at this point you are in a queue of sorts.. a holding pattern until the CO decides to finish the work...

Regarding my case,

1) My most recent divorce was last May, then I went to VN and married last October

2) 12 yrs age difference (my wife and ex-wife are the same age)

3) I also sponsored my ex-wife via I-129F in 2004 and she came to the States at the end of 2004

Any good suggestion for my case? thanks.

Hello,

Welcome to the world of AP. The past cannot be undone. Just move on and accept the reality that you may have to wait several months to get a result from the Consulate. As others have suggested, start doing research on Google on how to contact your Senators/Congressman. They are unlikely to force the Consulate to speed up the processing but at least they can continue to make inquiries on your behalf and let the CO's at the Consulate know that you are still serious about your case.

I recommend that you and your wife find something to do to make time go faster. I went back to school and it is proving to be a pretty good distraction from all the stress. Things are going pretty well for my fiance and I even though we hit a little bump in the road recently. Just prepare yourself for a long and frustrating wait. If you have the time and money, I would say pack up your stuff and visit your wife in VN for a while. Lastly, keep us posted on your progress. Don't be shy. We are all here to help you. Good luck :)

so you sponsored your ex over...a few months after the failed marriage you jumped right back to vietnam and did it all over again. they probably don't believe you the second time.

X2, sponsored ex wife, brought her here, divorce in May, married by October.... Major red flag. Were you dating the new wife before the divorce was final?

so you sponsored your ex over...a few months after the failed marriage you jumped right back to vietnam and did it all over again. they probably don't believe you the second time.
