Dear all, we would like hear your opinion on the dilemma we have on I751 Application.

My wife and me are planning to file for removal of conditional residence soon. We have the following as an evidence of bona fide marriage

-Joint Bank Account/ Monthly Statements (2years)

-Two Joint Credit Cards and 1 Debit cards

-Joint Apartment Leases

-Joint Club membership(AAA)

-Joint Car Insurance

-Utility Bills with both our name

-Pictures

-Affidavit letters from close family and friends

Our major doubt/dilemma is in our TAX Return. We filed tax returns as Married but Filling Separately. Does this appear as a major weakness and cause re-interview? We thought to amend the tax returns(to Jointly) but again it might appear as if we are try to hide something. What do u guys think we should do? amend the tax returns or just go ahead with what we have.

You do have quite a bit of good evidence. You could submit the tax transcripts you have, with an explanation as to why you filed separately. Someone else may be able to answer this better, but that seems like something USCIS looks for.

Whether or not you file jointly or separately is nobody's business but yours. Most people file jointly because it provides a tax advantage. What matters is that you both filed as married to one another.

I know some friends who have filed "married filing seperately" and they had no issues. Don't worry too much about it. Other than that. Adding affidavits, has never been my thing and I see it only as extra weight to the package. I am sure some members will disagree but I never submitted any for AOS nor the ROC. Good Luck!

As Just Bob said as long as you filed tax returns stating married to each other it does not matter if you filed jointly or separately. From USCIS perspective you have to prove married with each other and that's written clearly on the tax returns.
