Your main concerns at this point will be the restraining order and police report. The fact that you reported the first woman for immigration fraud will be an issue but that is easily addressed with an EOR letter concerning your first marriage. Since the second petition is for a CR-1 things will go a different route, but be prepared to deal with any questions and you will be fine. Lots of people have petitioned a second spouse after the first marriage failed for whatever reason.

As for the ICE issue, you have reported it and it is in their hands. The current atmosphere is that as long as she doesn't break a law (other than immigration fraud) they will probably not bother with her. It will be up to USCIS to deny or approve her ROC. All of that is out of your hands.

How does a woman take advantage of the USC? Easy. Pretends to be sincere and then drops him as soon as she gets to the US. That's how. Happens far too often. As for "trolling" for a foreign spouse. It isn't that uncommon to meet another woman from the same country. He has presumably travelled there at least once and may have people he has become friends with there. I know I have made quite a few friends in China over the past few years. Divorced in less than two years again is not that uncommon if the foreign spouse is just looking for a visa. A quick perusal of the VJ forums will show you far too many cases of women who dupe the man in to bringing them to the US and then claim abuse to get VAWA status.

I have been to the Philippines many times and I am very involved with the Filipino community. I have 3 godchildren there and my 2 closest friends are married to Filipinas. I met a bad apple the first time. She made me believe she loved me when I was there and she was a different person when she got here. As soon as she met other Filipinos here then she spent no time with me. She didn't sleep in bed with me, didn't wear her wedding ring and the list goes on. My kids from a previous marriage lived with us and are witnesses to her actions. I don't think marriage counseling is relevant on this site. I am just looking for some friendly advice. I met another Filipina and we are in love and started a family already. In a few years we will move to the Philippines together, but for now I am trying to get her here to live with me and my 2 other kids.

I wish I never met the other Filipina, but I did. I want to see her deported, but not sure what I can do. I reported her to ICE and they sent complaint to USCIS. If she uses VAWA to claim spousal abuse then it is my understanding that USCIS will not even talk to me as her petitioner to defend myself against such allegations. VAWA is put in place with good intentions, but it is a common practice to abuse VAWA for immigration purposes.

If I try to contact USCIS regarding my ex I am worried how that would affect my current petition. I am not sure if the best action is to do nothing since I reported marriage fraud already and see what happens or if I should send a letter to USCIS or call them or go there in person. Of course if I do nothing I may never know what happened with her ROC.

Thanks for any advice.
