HI ,i m married to a us citizen for 4 years and 8 months now ,we have a 4 years girl.my daughter is a us citizen too ,i got to the states on a k3 visa in June 2009 .till now i have no green card nor its pending because my husband keeps canceling, saw couple lawyers for advice and they told me that I m qualified for VAWA especially my husband was violent with me and my daughter before and got arrested one time.? My husband and I are working things out he said he s going to refile again for the 3 third time but I m afraid he will cancel again when he gets mad.

My questions: what s the process for VAWA?how long does it take? do I have to be divorced to do it?(my husband and I love each other and we don’t want divorce).the last letter i got from immigration said that i m out of status but uscis is not initiating removal procedures against me at this time.

please if somebody did VAWA before help me

FWIW - most applicants are escaping an abusive relationship - so you may have a harder time doing a VAWA with statements like this:

do I have to be divorced to do it?(my husband and I love each other and we don't want divorce)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Agreed. VAWA is for people to get out of an abusive relationship (which yours is). I think you will have a difficult time if you are still married and living with your husband. The big question is why you are. If he is violent with you and your daughter then what in the world are you still doing with him. There are women's shelters who can help you and putting your daughters safety in jeaopardy is unexcusable. Not trying to be preachy, but I remember your previous posts and it sounds like nothing has changed and if he keeps hanging the AOS over your head then you really have to think about what will happen in the future. There is no reason and no excuse for him not filing the papers.

My best suggestion would be talk to the local women's shelter. They have attorneys on staff that work pro-bono and they can give you the best guidance in filing VAWA. If there is no shelter near by then look for the YWCA in your city. They have services for little or no charge as well.
