Hi guys, apologies if this has been asked before. I've browsed the forums and tried searching, but I can't seem to search the Canadian forum alone, so I'm getting a lot of irrelevant results.

I'm a Canadian citizen marrying a US citizen, and am moving to the US. My question is regarding the K1 visa - I read somewhere on the USCIS website that visa recipients are not allowed to leave the country throughout the entire processing, and that it can take up to two years or more, except under special circumstances. Now I can't find where I'd read that, but I'm wondering what exactly these special circumstances are. My entire family lives in Canada, so if some special function were to come up (eg. a death, marriage, etc) - would I be permitted to travel in that case?

If anyone can link to previous threads of Canadians who have applied for either the K1 or K3, please post them - we're still deciding which is better for us.

K-3 is useless. Don't even bother. If you are going to get married file a CR-1. Its cheaper and you get your green card on entry to the USA. means you can work right away and travel right away.

K-1 you can visit the USA but you cannot move there until you have the visa in your hand. You petition for the k-1 move through the system go to your interview and get your visa. You enter the USA you get married ASAP!!!! and file for AOS EAD and AP. When you have your AP and EAD you can work and travel before getting the green card IE - you have an emergency in canada you can travel there with AP. You then get your green card and you do not use your EAD or AP anymore because you use your green card.

K1 can take around 7 months or less, and getting the green card after marriage and filing it can take a couple of months to 4-5 months. You just cannot leave the USA without AP or the green card after you enter on the K-1 or you will be starting all over again because a K-1 is ONE TIME USE. One entry, one use, void.
