You would only have a Tax Transcript for the previous fiscal year. No one at this point would have a tax return for the job they worked in the year 2011, as we will all be filing in 2012 :)

So as someone already mentioned, get copies of your pay stubs and a letter from your employer.

However, since you don't have taxes filed for 2010 or 2009, I believe you may still have to do a Co-Sponsor. Someone correct me if I'm wrong. But, I was under the impression that you would have to show you are 125% above the Poverty Line and that a pay stub and letter from your employer amounting for less than a year was not enough. I would also provide bank statements that are official if you have money in your savings. I apologize if I'm wrong in that statement though.

Alright i got it thanks ! So I have to send them bank statement, pay stubs and letter of employment !

What should i send instead of tax return ? Or how should i explain it to them ?

If you have joint sponsor on K1 stage - nothing! Only stuff from your joint sponsor. You may (if you want) attach the letter explaining the situation.

I'm a bit confused as this is currently 2011. In Jan of 2011 you should have gotten w2 or 1099 paperwork for eanings for 2010. Each years taxes are payable anytime the following year up to april 15th. In jan 2012 you should get paperwork for the 2011 tax year. So if you did not work in 2010 what did you file for 2011? 2011 period wont end until december of this year. But in general I would suggest finding a good immigration specialist to help you. It doesnt have to be a high priced lawyer there are plenty fo freelance uys that are good at this for a reasonnable fee. Jim.

A lot of consulates will still go by the 125% guideline, since that is the mark you will have to meet for AOS.

The petitioner should fill out the I-134 and provide pay stubs and a letter from his employer stating his current income. He might even wish add to a statement as to why he did not previously file taxes. The joint sponsor will fill out their own separate I-134 and provide their 2010 tax transcript, pay stubs and letter from their employer stating their current income. Check with your consulate to be sure they accept joint sponsors, if they require only the most recent tax transcript or the past 3 years, and if the income must meet 100% or 125% for the household. Since consulates vary so much, it is important to find out exactly what is acceptable for the consulate you are applying at.

Hey, we have a very similar situation. my fiance just started working last March 2011 so we didn't have tax papers as well. What we did was to submit the following:

1. I-134 filled up by fiance

2. Employment letter

3. Pay stubs, around 6 stubs

4. Explanation letter why we don't have ITR papers yet

5. I-134 filled up by co-sponsor, his mom

6. Employment letter of co-sponsor

7. Pay stubs of co-spnsor

8. 2010 ITR papers of co-sponsor

9. Bank Statement of my fiance

I had my interview last July 25, and got a favorable result.
