Hello guys!Good morning! :)

Hello guys I need help I just want to ask about DWI drive while intoxicated case.I have story to tell my husband commit DWI 2 yrs ago.I meet him 2010 and we engage we get married this year 2011 of his 2nd time coming to me and on that time i know that already that my husband have a case DWI and still ongoing in court . Finaly last june this year his DWI hearing was finalize he found guilty and he stay in jail with in 26 days.My concern about it.Its DWU case of his staying in jail as correctional can denied our application?specialy right now he is undergoing house arrest !Anyway his offense is not major its just minor offense only iam just worried if his DWI can cause problem of our application.We just recieved our NOA1 copy last month after 8 days we sent our I130.So right now were waitng the next step and next email of USCIS to send to us.Thanks for reading and hoping for your kind response guys.Have a good day!

It will have no impact on your case.

On a personal note you might want to encourage him to address his drinking problem though as continuing to get DWIs will eventually cause him to lose his drivers license and the court costs & fines will continue to increase with each conviction.

Assuming your husband is the USC, this should not have any bearing on your application. The criminal background of the USC does not come into play unless it involves something like domestic violence, child abuse, sex crimes, etc. They'll know about it, but it shouldn't hurt your application at all. Good luck.

If he is deemed to be a heavy drinker he will be denied based on his "harmful behavior". I know this to be true as it happened to us when my husband applied for a visitors visa. My advise, tell him to stop drinking, show rehabilitation, and expect a lot of scrutiny

Okay guys thanks for the responce yea that was 2 years ago my husband never do it again He learn his mistake.He have a atty to get his driver license back. Were just worried if it can cause problem of our application.Thanks again and Good luck also both of us here.God bless and have a good day!

Yes he stop drinking now and never do it again .Thanks for ur response.Were ready to face new challenge in life and start new life together and hoping soon we can recievd our approval.I trust my husband he is a good person and he learn his mistake.

USC doesn't have to do a medical.

Husband is the USC. He's already in the U.S. and it will have no bearing on an I-130 case based petition. An I-129F based petition has to provide records if there are 3 or more alcohol-related convictions and requires that the US Gov't disclose these to the fiance(e), but they are already married and, in any event, she obviously already knows about it.

Should be no effect other than a potential slowdown in processing times while they do background checks.

June 2, 2016 - Interview - Recommended for Approval

thanks for the comment!My Husband is not heavy drinking!Im always remind him not to do it again!I hope evrything will be okay iam worried a little but iam ready now in whatever happen .And still keep on praying that evrything will be okay! No he is not the one who applying VISA.He is US citizen he is american.He married me Iam a Filipino he is my petioner who apply a visa for me.

He also did not apply for a visa for you. He filed a petition in your behalf. When HIS petition for YOU is approved, YOU will be invited to APPLY for a visa.

Stay sober get a cab, DWI has grown with the help of MAD and is generates a lot of revenue. I think the penalties will only get stronger. Good Luck.
