Hi guys! I'm new here. Just wondering if someone could shed some light regarding my confusion with the Letter of Intent. My fiance came to the Philippines for a month vacation. He just left a week ago. He will be having his final hearing for his Divorce next week (but he's been separated for 10 years now.) Before he left, we already prepared all the necessary documents especially those needs to be signed by me for the filing of my visa. I am just wondering, I prepared and signed the Letter of Intent to marry him before his hearing for the Divorce, does the Letter of Intent need to be done after his Divorce or do you think USCIS will still accept the letter even if it's signed before his final Divorce will come out? We prepared the documents ahead of time to avoid the shipping expenses. Thanks in advance for your help. =)

08/09/11 Delivered to Texas

08/12/11 NOA1 Confirmation thru text and email

08/15/11 Received Hard Copy of NOA1

09/16/11 Called USCIS to file Expedite Request

09/19/11 Sent medical cert/proofs to USCIS for Expedite Request

09/30/11 Post Decision Activity Status on the USCIS website

You can set the date of your letter at a later date after final hearing of his divorce.

11/12/11 - Biometrics Appointment received

11/28/11 - Case transferred to CSC

12/7/11 - Biometrics done

1/2/12 - EAD and AP approved (Card production)

1/20/12 - Got Driver's License!

3/7/12 - GC approved!

3/9/12 - Got a job!

3/11/12 - GC on hand

I am not well verse with the law, but I think you should execute the letter of intent after is able to finalize the divorce. In my experience with my fiancee. It still took awhile after his last hearing to get the finality of the divorce..i.e getting the divorce paper. It wont hurt you that much to mail the letter of intent if and when he is all cleared. It's better to be sure than sorry :D

I agree with paul_kay. :thumbs:

This "finality of the divorce" thing makes me remember of one funny moment (about the jealous ex who is so mad for already having a relationship with someone without the finality of the divorce yet). Well, everything is okay so far. :)
