Re-opening denied I-90

My MIL is here and wanting some assistance with renewing her GC. She went in Nov for her Biometrics to renew her GC. A couple of weeks ago she got a letter in the mail saying that he application has been denied because apparently they scheduled a 2nd bio appointement, but she never got a letter.

I know that she has to fill in the I-290b, but they sent her another list in the mail saying something about an EOIR from from the dept of justice. They didn't specify any particular form, just that the EOIR froms can be found at this website www.justice.gov/eoir I am thinking that they sent it because she was upset about having to pay another $630 for something that wasn't her fault so they were referring her to the fee waiver form.

Is there any other forms that she NEEDS to fill out other then the I-290b to have her case re-opened?

The I-290B is the only form that's required to request a denied I-90 be reopened.

She can request a fee waiver with the I-912, but she will have to present financial evidence to prove that she qualifies for the waiver. Receiving means tested benefits, or having a household income under 150% of the poverty guidelines, or having a financial hardship like unemployment or medical expenses are all valid grounds to request a fee waiver. Believing that you shouldn't have to pay because the denial was not your fault is not a valid basis to receive a fee waiver.

Thanks Jim. That is what I thought.

It really sucks that she has to shell out $630 for something that is not her fault. I have never understood why USCIS sends important documents such as these with no tracking or comfirmation.

Why not involve her congressman before shelling out more money? Gather all evidence including NOA1, bio notice and find the congressional immigration aide for congressman - they should be able to get this re-opened and card mailed to MIL.

Why not involve her congressman before shelling out more money? Gather all evidence including NOA1, bio notice and find the congressional immigration aide for congressman - they should be able to get this re-opened and card mailed to MIL.

She contacted her congressmans office as soon as she recieved the notice, but so far they have not been able to do anything for her. She is submitting the I-290b today since she only has a few days left before the window for re-opening closes. I have had her send in all the evidence including the original bio appt letter that was stamped that the biometric were completed.

I told her to contact the congressmans office again today before she sends it out to see if they have any more information and just have not contacted her for some reason.
