Hi, I'm an American citizen DCFing for my Peruvian wife's immigrant visa. I already filed form I-130 in the embassy, and got sent by mail an interview date and a list other stuff that my wife has to take for her interview. However, we have some doubts on filling some of them out.

First, on the form OF-179, do I (the petitioner) have to fill it out, or my wife does? If its her, what is she suppose to answer in question 16, where it asks if her husband (me) has ever been in the US, and when and where did he obtain his visa? (none of the choices are "he/she is a US citizen") Also, which visa did he use to enter the US?

Then in question 17, it asks if her husband has ever lived in the US, and then asks for the date of admission etc....

So basically, if I'm the one who has to fill it out (as the petitioner), it would make sense, yet nowhere in the form specifies.

Second, in form I-864 Affidavit of Support, right now I'm living in Peru with her, working as a volunteer, so I have no annual salary nor have I had to pay taxes. However, with her assets and my current savings account, we qualify (multiplying by 3 the difference between the current poverty guidelines and my annual income). Since I'm living here in Peru, I don't have a domicile back in Puerto Rico. My plan was to go there during christmas (living in my parents house meanwhile) until I find an apartment for us. I'm also going to join the coast guard, so I'm not worried about finding a job.

Now my question is, will I have a problem in the interview because of all this??

Any help will be GREAAAATLY appreciated!!!

Not familiar with form OF-179, so can't help you there.

In regards to the I-864, not having had paid work for the last few years is not a problem- just write a short letter explaining why, and that because of this you were not required to file taxes with the IRS. I am confused about what you say on the assets: Yes you can use assets- it is what we did- but you say "multiplying by 3 the difference between the current poverty guidelines and my annual income". I thought you had no current income? In any case, surely if you have income it is in Peru and thus will not continue when you go back to the USA and thus won't count? Also keep in mind that most US embassies want to see the assets being based in the USA. Check with your local consulate if they accept your wife's assets in Peru.

At her interview, she will need to show that you either have or are taking serious steps to re-establish domicile in the USA. Domicile is not living there, but being based there. So for example, having a letter from your parents stating they welcome both of you and that you can stay with them; evidence you have been looking for a job; having bought a home for you two to live in or signed a lease, or at the very least strong evidence you have been looking for somewhere to life...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Not familiar with form OF-179, so can't help you there.

In China the OF-169 is the P3 country specific checklist so the OF-179 is likely the Peru specific checklist. I would contact the Peru consulate and ask them who is supposed to fill it out. It certainly sounds like the questions are applicable to the beneficiary more than the petitioner.
