Hello!

You all were so helpful in getting me married to my Peruvian then-fiance. I hope that someone will be able to give me some information on how to get the divorce.

After being married 1 year and 1 month without even starting the petition, the cat is now out of the bag: she was using me for money the whole time and had no intention of coming here. She kept telling me "We will do the documents together next time you visit," but then would say the same thing each 'next time'.

I've looked all over my google search results but I can't find any solid information. Ideally I would much rather get an annulment if possible.

Potentially useful info:

-We married June 25, 2010

-I am a US citizen residing in the US (New Hampshire)

-She is a Peruvian citizen residing in Peru (ate vitarte, Lima)

-I have no proof that she was using me. It's just something I slowly figured out and when I asked her she admitted it ("It's not my problem", she said.. lol)

-She said that she's trying to figure out how to get a divorce there, I don't know how or if that will effect anything on my end

-I have near-zero way to contact her at this point. I have her cell number and I am friends with a few of her family on facebook but that's it. I can say with confidence that she will not respond if I call or text her, even for the purpose of getting the ball rolling with the divorce (annulment would be much better)

-I filed my 2010 income tax return as jointly married to her. Other than the documentation that was necessary in order to get married in the first place (New Hampshire State House and the Peruvian Embassy in Boston), this is the only 'trail' of the marriage that has been left here in the states.

I would much appreciate if any knowledgeable folks out there could throw me a bone on this one. I really want to be "single" and not "divorced". Thanks a million guys.

Also, if she gets divorced in Peru does that mean that I am automatically divorced here with no hope for annulment? From what I understand, she cant get any sort of divorce or annulment without officially notifying me (Which includes hiring a US'ian to serve me the papers which I know she has no way of paying for, let alone all the other costs she will incur). I could probably afford to have some papers served to her, and I doubt she would object to them.

I'm considering the idea of doing this in early 2012 so I can file my taxes jointly married again for 2011 and use the extra cash to offset the costs of the divorce /annulment.

It appears that you do not have grounds for annulment in New Hampshire but you will have grounds for divorce. Here is a useful listing of grounds recognized in New Hampshire:

Another question if I may--

If we get divorced in Peru without contest, will that help my divorce proceedings here in the states at all?

So for example, would I be able to go to court and say "Well we're already divorced in the state in which we were married." ?

Would this be beneficial in any way? If so I'm thinking she can just pay for the divorce herself as I gave her plenty of cash to do so. In the meantime I can just keep filing my taxes as jointly married :0

why would you need to get divorced in both peru and the usa?

I guess I just assumed that I did. That's actually kind of awesome if her getting a divorce in Peru terminates the marriage. So I'm thinking I'll let her take care of it and get a copy of the divorce certificate or whatever it is in case I need it.

you'll need to get the divorce recognized by your state. for that, you'll need specifics from someone more adept at that than i, but i suspect it will involve an official version of the peru divorce decree, a translation of that decree, and filing it with your local court.
