so those of you v'jers who have read my post about my 14 year old son admitting in the interview he tried cannibis once here goes,i did my interview on the 13th of july,his medical was sent directly to the embassy but on the day of my interview it could not be found. they told me to pay dhl and said they need to have the medical before they can proceed further. they received the medical on the 18th of july and this morning i received a email from them saying they have scheduled me and him for a blue slip interview on the 4th of august to discuss his medical results. he maintains that it was only once months ago.will they really deny him for this?? has anyone ever been in a similar situation?? has anyone ever been blue slipped and get approved?? this changes everything.

Unfortunately, the Jamaica consulate takes cannabis use very very seriously. If his drug use was less than 2 years ago, that's basically an automatic denial, sadly. It won't affect your approval, but he will virtually certainly be denied.

He can try again in 2 years.

The substance abuse ban has been reduced from 3 years to 1 year in June of 2010.

basically it says: The American Psychiatric Association's Diagnostic and Statistical Manual of Mental Disorders (DSM)defines sustained, full remission as a period of at least 12 months. So now the immigration laws have been changed in accordance with this definition in such that the ban is no longer 3 years, but 1 year full remission (no drug use).

staceluvyou I am so sorry, but the answer is undoubtedly yes :( they can, and very well may deny your son's visa for admitted drug use, they have done it on many occasions.

I seem to recall reading that one time experimental use was not a cause for ban, I need to find that info again...

Truthfully, I would consult with an attorney before your blue slip interview :(

thank you for all your replys, but i don't think i'm gonna consult a lawyer. i put everything in God's hands and what is to be must be. he never makes mistakes. i'm just tired right now. this whole process has been dragging and just when u think you are gonna get a break it seems farther away.

I'm probably misremembering it from a previous post I saw about a similar denial in Jamaica. Your numbers are much better substantiated and much more likely correct than mine.

Stacey -- i know it will work out. Let's how the substance was not found in the blood test so you could state that he will not use it again and hopefully he will get his visa.

She had to redo medical and is now in the USA. It is not the end of the world, you just have to prepare for the possibility that you might have to leave him behind. He also has to be responsible and never touch the weed again.

thank you fashiondoll for your encouraging words, i am already preparing him for the denial. he says he's sorry and he won't do it again. he understands that there is a 90% chance he will be left behind. he's a good kid and i pray he will just be humble no matter what the result is.you know in these days you don't want to leave your teenage son behind in jamaica. but as i said, i leave it all in God's hands

Stacy, I am sorry you are dealing with this - JAP gave you the right information - there were others denied and given the ban in the past (not even for a positive test, but for an admission of use) who are also now in the US - But the law has now changed and it's one year post last use that he would have to go back for a second medical, and then he should get his visa if all is well -

Incorrect information bigdog - Read the whole post and the links - the law was changed in 2010 - it is a one year past LAST use wait.

Hang in there. You already know the worst case scenario is a 1 or possibly 2 year ban, but given that he is a minor their might be some leeway given. I don't know how they look at this fact in Kingston, but you can only hope and have faith that things will work out for the best. I hope it goes well and it works out to be a good scare and a good lesson for your son.

Please post the results when you have the interview. Praying that it will be good news for both of you.

I know drug use is not a good thing, but this rule needs to change. If you apply for a job with the FBI, yes FBI, they ask if you have experimented with marijuana. As long as the use was limited, it will not prohibit admission to the training academy...because they know that even intelligent college students will experiment. Of course, admitted use of narcotics is an autofail, but my point is this seems a little extreme to me. Good luck! :thumbs:
