Hello, I am helping a friend out by being a co-sponsor for their parents they're bringing to the U.S. The form (affidavit) requires that i include a tax return and there are household income requirements. By supplying my tax return that my spouse and I filed jointly, is my spouse's income included automatically or would they have to file a sponsorship form? I want to make sure my spouse isn't held responsible. Any help is greatly appreciated!

Also, is my income counted for my family only or my family+ my friend's parents? (In calculating if I make enough money).

Thanks!

The I-864 is an individual form. Meaning only one person's income is listed. You would support your individual income claim with an employer letter and recent paystubs. You can find the sponsor's responsibility in the sponsor's contract on pages 6 & 7 of the I-864.

Each person being sponsored requires an affidavit of support. (Sponsoring 2 people, submit 2 forms)

Your household count is you, spouse, any dependent children, any other persons that you have sponsored, and the intending immigrant(s). Q 21 on the I-864 will help you get the right household count.

no, it's not automatically included, he would need to file the i864A.

you would include copies of your W2s, paystubs and employment letter which will show your annual individual income. parents petitions are filed separatly, so would you sponsor both parents or only one?

you have to cover your own family + the person you are sponsoring.

thank you for the replies, very helpful!! I have a few other questions i hope you can help answer..the sponsorship is for both parents..on question 21 (F), where i'm supposed to list other people i have sponsored, would i include the other parent? So, on his mother's sponsorship forms would i include the father as a number, or no? Also, on the first page, question 9 & 10, do i count both parents on each form? Under total # of immigrants i'm sponsoring, would i count them both and enter 2?

You guys are wonderful thanks!

Most recent year's tax transcript / tax return is required (page 8, I-864 instructions). Pay stubs and employer letter are used to demonstrate sponsor's current income claim.

Section 9 is for listing immigrants who are receiving a visa as a derivative of the primary beneficiary's petition; i.e., people immigrating on the same petition as the primary beneficiary. This isn't the case with your friend's parents - each has their own petition. You don't include mom in section 9 of dad's I-864, and vice versa.

Question 21.f is a little ambiguous, isn't it? Technically, you aren't liable as a sponsor until they've received their green card, and question 21.f specifically asks you to count people who are now lawful permanent residents. If you indicate a number here then NVC might conclude that there's a third immigrant somewhere in the US with a green card for whom you've signed an I-864. Personally, I would write "zero" here. The visa officers at NVC can add - they'll figure out your effective household size.
