k1 Fiance interview at Mumbai Consulate

hmmm... this is just a possible hunch. Perhaps when your US fiance stated that you guys want to marry in the US because you have a lot of family in the US, Europe, and Dubai that is what raised the red flag. While I don't necessarily think it should raise a red flag for a K-1 type visa, it absolutely raises red flags for tourist visas. Perhaps you had a consulate who is either uninformed or from his prospective feels like when one has family in the US there is a much greater potential that visa fraud is going to occur and he's probably patting himself on the back for getting the info out of your USC fiance that YOU the beneficiary have family in the US. Like I mentioned, this is all just a hunch. But if it were me in your shoes, I would make sure that wedding guest list is a short as possible and has only a very limited numberof YOUR family members that live in the US on that list as possible. YOu have to provide at least one name of your family members living in the US as your USC fiance told him you have family members in the US, but I wouldn't send some huge list with numerous friends or family members of YOURS that live in the US. Just My Opinion

Hi, First of all...security check in not the problem here....he was asked to submit documents...so if you guys work on why CO think that he or she should get married in india then there must be something in his case that alert CO that he or she is married ......even not engaged.....THERE MUST BE RED FLAG IN YOUR CASE...you can not find out it is different thing....work on why CO think like that....rather than teaching them what you are thinking....argument has no place in any US Consulate in world....put yourself in place of CO...then you will understand problem at hand can improve you chances next time.....please do tell us your religion and which state of india you belong to....one more thing.....IT ABSOLUTELY DOES NOT MATTER TO CONSULATE WHETHER YOU ARE PRESIDENT OF THIS WORLD OR MOST RICH PERSON IN THIS WORLD....for them everything is same.....so make no mistake of thinking that you both are working as an executive so CO will approve visa....best of luck..

Yes we have been working on that direction and both me and my fiancee understand that CO is only doing her/his Job..my fiance did not argue with the CO at all...as a matter of fact her CO just refused to look at any evidences...she said I am convinced of your relationship, CO was just stuck on one point that his family lives in Duabi and yours in India, then why u want to marry in US...My fiance gave reasoning behind our decisions...which seemed to convince her to a point...she said alright I consider your answer and just submit the guest list of people who attended the ceremony....

We r muslims and both r from Mumbai...security ccheck might be an issue here because of iur background..its a possiblity which v r not completly denying..consulates are known to use this trick of asking for documents to buy times to do more security checks...but as i said its just a theory tht v r not completely ignoring...

Also at no point I SAID OR TRIED TO SUGGEST THAT SINCE BOTH ME AND FIANCE ARE EXECUTIVES SO WE SHOULD BE TREATED DIFFERENTLY...I DO NOT KNOW HOW YOU GOT THAT IDEA THAT I AM SUGGESTING ANY SUCH THING..I HAVE GONE THROUGH THE IMMIGRATION PROCESS SEVERAL TIMES MYSELVES SO I UNDERSTAND VERY WELL THAT YOUR REPUTAITON OR SOCIETY STATUS DOES NOT INFLUENCES CONSULATES IN MAKING THIER DECISIONS...I mentinoed about our professional designation as someone inquired about it to help me to get the best advice...just like you did inquire about my religion and region to help me to give the best possible advice..

I appreciate your time and efforts to help us here...

thank for your opinion...you may be right...as someone suggested that its a norm that when indian families are spreadout in the world..they tend to go to India for wedding as than going to US...and CO seems to be working on that logic that why u guys are just not getting married here and then go to US...

u r also right about the inexpereince of CO..as per my fiance, her CO was a very young girl probabaly of her age..and young people do tend to behave in certain manner based on their own thoery or beliefs...our CO was ignoring our reasoning that not all family feels safe to go to India or prefer to go to India...specially those living in western world.. also I have been living in USA for over a decade now...I have more friends and accuintences here in USA than in India..its my personal choice and preference to get married in the country where I am living at present...i could have got married in India but then there is this question of how much time you get to spend with your newly wedded wife as you do not get over a month of vacation in USA..to avoid such situation we simply choose to go the fiance visa route as there would be no more seperation after wedding as being in long distance relationship is tough anyways...but our smart COs just dont want to understnd that and see everyone as a potential fraud..I dont blame them as I undetstand they r just doing their job...my problem is they seems to sometime look at everyone as fraud and do not understand behind papers and case #s, there are real people and their life is involved..

Other correction from your suggestion is ...they are not asking for the future wedding guest list...they are asking for guest list of our engagement ceremondy which happened over a year ago...they want to call those people and verify that v r not lying about engagement...we are gladly going to submit the list as we have nothing tohide..my frustration is its just delays the whole process and you don't know when are they going to schedule the interview again...till that time everyone involved feels tensed due to the uncertantity of the situation..

Hey pal, one thing you mentioned totally wrong in your earlier post by saying that you have relatives in usa..Why??? ...now you are saying you have relatives only in india and dubai...well....one more thing....they know all family tree ...i mean your relatives ....if you can ask them they can tell you name as well....okay about security check ....now i think that is possibility...anyway that we knew after you told your background....one more thing ..though it is very personal but never hate the land where you born...pay homage to it every way you can......Where in the world you can best celebrate marriage......the ANSWER IS INDIA....marriage is institution in india......MY BEST WISHES with you...please do not give them what they have not asked you.....do not invite trouble yourself...it will not be counted as plus point anyway.

Sorry for the confusion. I have my immedaite realtives in Dubai..like my mother, brother and their wives...and then extended family living in UK and USA..like uncles, cousins, nephews etc..

I never said I hate the country I was born..it would be so foolish of me to say any such thing..i just do not prefer living or visitng there due to the bad experiences of how badly the system works there..anyways thats up for the discussion some other time...right now I am more worried about getting my fiances visa approved..

thank you for your suggestion about the additional documents submission..I think I agree with you and will act on it..thanks for your wishes too..

So finally we submitted our guest list to Mumbai embassy on Thursday...does any one has any experience about how long they take to make a decision after submitting the documents they have asked for ?

Hey U & I... Sorry to hear about your predicament. I read through your posts and was wondering, did your fiancee not explain to the CO that through the Fiancee Visa route, she would get to come and be with you much sooner than through the Spouse Visa route? Or did she explain that and the CO just didn't understand?

And, unfortunately, I don't know the answer to your question above, but please keep us updated!

thanks for the sympathy...

CO did ask why you are going through K1 visa route and not get married and file spousal visa...

My fiancee told her exactly what you mentioned here...that since we are already in a long distance relationship from last 4 years and that we want to be together after our wedding...and we thought that Fiancee visa would be faster and best way to avoid seperation after wedding...on her reply, CO responded very rudley to her saying that's BS...from where and how you are getting this information about Fiancee and Spousal visa..my fiancee calmly replied to her saying my fiance is a US citizen and been living there from a long time and offcourse he has done his research...on hearing this response CO kept quiet and moved to the next round of abuse and allegations...

Basically, they treat u very badly..I am holding on to put our review of the interview till we get some results as I don't want to sound like a sour grape...
