K1 interview at Mumbai Consulate

My fiancé just had her K1 interview today. CO was convinced of our relationship and all of the other documented proof we submitted. But still she didn't get visa. Embassy officer had only one concern that is "why we didn't get married instead of getting engaged?" My fiancé did her best to convince that we are not married yet ( we are actually not ) and explained to her our reasons of not getting married since most of my family and friends lives in US, Dubai and London and they all prefer to come to US for the wedding than in India. After few more Q & A, CO said that she is convince of our relationship but she needs more proof that we are not married and only engaged. She issued her 221G, returned her passport asked for the guest list with details such as guest’s contact info, our relationship to them and asked her to submit this guest list to VFS Mumbai.

My question is…Do they really call the people on the guest list to verify? It seems very odd to me since the list is provided by us and we can always train people to say what we want them to say. And consulate people are smart enough to understand that. Then why ask for the list? I fail to understand the reasoning behind it.

At this point, although we don’t have the visa but we are not denied either. What do we make out of this situation? Should we be worried?

I don't know why they ask for that extra proof, may they just ask just to scare the people who are frauds away! I hope others who had experience answer, but I know that many people who submit the extra proof get the visa later (and some do not, no matter how much proof they submit). I also haven't heard about them contacting anyone on the list.

Anyway, get that info to them ASAP and good luck for the approval! :thumbs:

Thank you for your response and wishes. We are ready with the list ( since only about 35 people attended our engagement ) and going to submit it tomorrow. Hoping for the best.

Its kinda weird how to prove you are not married. I can see CO prespective in most cases when families are spread out thru out the world most Indian families prefer to come to India for wedding over to going to US for the wedding.

They want to prove you are not married because K1 Fiance visa is easier and faster then getting the spousal visa. Also, if both parties have many relatives in USA, they are afraid it is a fraud relationship and the person just wants an easy way to arrive in USA to be with his relatives.

I also assumed that K1 visa process would be faster which turned out to be completely untrue...and not sure about the easier part as well..

they do not have doubts about our intentions..they are asking us to proove that we are not married and only engaged..as per CO, our body language in the picture suggested that we are married.. ( don't understand why CO coulnd't understand that two people in love would also have the same body language..married or not )

my fiance does not have relatives here other than me..I do have an extended family who lives here..

As I mentioned earlier in my post its kinda weird and I don’t know how one can prove they are not married and only engaged.

If it is other way around say someone ask me to prove I am married I can do that by producing the marriage certificate, unfortunately there is no such certificate for single or engaged….. lol
