No argument - anything that raises doubt in the AO's mind is to be avoided.

Healthy interval between entry and marriage is advised - try to time it according to processing timelines posted here on visajourney.com. Choose your local office, see how long processing takes, add some time for medical and document collection, arrive at the convenient date. It only has to be civic ceremony.

Most students on F-1 go in and out of the U.S. to go home for holidays and breaks. So while there may be a short period of time from the latest entry and date of marriage, the overall time that the F-1 visa holder has had the visa may be very substantial (e.g., all four years of college, or the time in grad school, etc).

Just a thought.

9/4/06 - AOS package accepted at Chicago

9/11/06 - ND AOS package

9/14/06 - NOA AOS, AP and EAD

9/16/06 - Biometrics letter received

9/18/06 - All touched

9/19/06 - AP and EAD touched

9/20/06 - RFE notice by email (verify income and employment)

9/23/06 - Biometrics

9/25/06 - NOA I-130 (finally)

9/26/06 - Touched AOS and EAD

10/4/06 - Returned RFE materials by USPS Express mail

10/5/06 - RFE materials signed for by D Atwell

10/12/06 - E-Mail notification RFE material received 10/10/06

11/3/06 - Received interview notice (for 12/18/06)

12/18/06 - Approved with letter in hand (no stamp)

1/3/07 - GC in hand Remove conditions 9/18/08

Overall time is irrelevant.

What matters is that you present yourself at the POE on your last entry as a Student, not as an intending immigrant who may well be continuing studies, but is also intending to stay.

Been a while since I revisted this thread I created. We're taking our time getting everything together to send in, as I'm very detail-oriented. I'm glad you brought this up so that I can prepare for it come interview time. The question of 'substantial' is provocative, and I imagine quite the grey area. Before we got married, she re-entered, completed one semester and started another semester. We got married about two weeks into her second semester after her MOST RECENT re-entry. It's now over 8 months since she's last entered as we're preparing for the submission. Hopefully it's enough. If not? Whatever. I have a PhD in Mol. Biology and I'd be thrilled to teach a year or two in India as a culture-bridging experience. :)

December 22, 2006 Biometrics: Thanks Charlotte office for the same-day service!

December 30, 2006 Second Biometrics appt rcd:

January 06, 2007 AP is approved!

January 10, 2007 EAD is approved

February 13, 2007 AOS Interview: Appoved with passport stamping!

February 26, 2007 Greencard received!

Removal of Conditions:

February 12, 2009 I-751 Received.

March 17, 2009 Biometrics.

July 8, 2009 Card production ordered!
