i need some help please ...about I130 and I129F

Hello guys,

I am a romanian citizen married with an usa citizen and we are at the first step in our long process(CR1 -we are married only for 2 months :) applying for I130 and I129F also) ....we want to file the form I130 and i read so many info on so many sites (including uscir site) but there are stil some things that i didnt understand it.The first step is my husband to file I130 form,this is clear for me.After we have to file I129F....what i dont understand is when i have to apply for it?...when USCIR inform us that it has received the petition I130 or when I130 its already approved or we can file both at the same time?

In case that you need more info about my case ,we both are at the first marriage ,we dont have children,we know each other for 3 years ,yes ..we have seen twice in the last 2 years,we have pictures and a lots of conversation on messanger,we decide to marry and we got married in romania in may this year and i want to apply for K3.

Also do you know how many evidence of our relationship we have to send when we file form I130,or i should ask ...how many it means enough?

Oh and one more question ,lol,seems i have a lot....how much time it takes to approve a form I130 ,i know it is not a limit time but if you would share from your experiences it will really helps me .

If somebody is or it was in my situation please help me with some information because i am so confused ,for a few days i keep reading about forms and i think in my head its a mix of info right :unsure: now and i have to clear things a little ...for sure i have more questions but in this moment i dont remember all of it... thank you guys and good luck to all of you.

Forget about the I-129F there is no point in sending it. It will take longer and cost you a lot more than just filing the I-130.

With the I-130 CR-1 spousal visa you will have a green card on entry and can look for work right away.

With a K-3 you do not have a green card on entry and pay an extra 1070$ to get it with another 5 month wait to get a green card.

Forget about the I-129F there is no point in sending it. It will take longer and cost you a lot more than just filing the I-130.

With the I-130 CR-1 spousal visa you will have a green card on entry and can look for work right away.

With a K-3 you do not have a green card on entry and pay an extra 1070$ to get it with another 5 month wait to get a green card.

Inky thanks so much for your replay ,i know it will cost more and i will not have my green card right away but i want to choose the easier way to be close to my husband quicklier ,i read also that if you have the I130 approved first the I129F it will be canceled ,so we want to do both ways to be together earlier if its possible:)

The 129F stand for Fiancee......since you are already married then you should apply cr1/ir1 or K3. The K3 is almost unheard of but possible. OP, if the I-129F is filed after the I-130, the following will happen: USCIS will tie the two petitions together by pulling the I-130 from its current place in the queue and placing it with the I-129F that was just filed. If both petitions end up at the NVC at the same time which would result in the I-129F being administratively closed, you will have not saved any time and in fact gave up some time.

Ultimately it's your call.

Purpose of Form :

To petition to bring your fiancé(e) (K-1) and that person's children to the U.S. for marriage to you or to bring your spouse and that person's children (K-3 and K-4 visas, respectively) to the United States to complete processing for permanent resident status (under the LIFE Act and Amendments of 2000).

Wrong. K-3 does not let you go to the US and wait there for the CR-1 IR-1. Go back and do your research.

Wrong. K-3 does not let you go to the US and wait there for the CR-1 IR-1. Go back and do your research.

No, a K-3 is a spousal visa you wait in your country till you are granted the visa. Then you enter the USA on the visa and you have to apply for AOS to get employment ability. AOS costs 1070$ and you have to wait around 5 months.

This is why i said forget about K-3 it takes MUCH longer than CR-1.

CR-1 you get the visa enter USA and can start working because you get the green card on entry.

They are completely different visas.

K-3 costs USD $1705 for ONE person!

CR-1 costs USD $945 for ONE person!

A K-3 Visa allows a Non-US Citizen (spouse) married to a US Citizen to legally enter the US and adjust status to become a Legal Permanent Resident

A IR-1 / CR-1 Visa allows a Non-US Citizen (spouse) married to a US Citizen (see note at end) to legally enter the US, immediately becoming a Legal Permanent Resident upon entry.

The K-3 visa is closed at NVC. If you apply for this it will delay your entire application, just file the I-130 spousal CR-1 and forget about the K-3.

Big PS - if yer reading the GUIDE section, for a spousal visa - there's steps on the I-129F submittal.

No one has deigned to remove this bit, as USCIS will blindly process that additional submittal - so it still smells like a viable option for you -

just until the point where...

both approved petitions travel into NVC, and NVC declares shenanigans.

Did I say that ? really? SHENANIGANS...

The base concept, the underlying rule, for an I-129F petition to be carried into NVC, processed, flipped to the US Consulate/Embassy IV unit in the hopes of a K-3 visa -

is

(wait for it... this is the important bit)

an unapproved I-130 petition.

USCIS has gotten really good at approving both petitions simultaneously, since 2006.

Automation for Namechecks, and removal of entries in a 3-year-long namecheck queue with the FBI --

pretty much solidify the concept of both petitions being approved on same day, and

both petitions travelling together into NVC.

NVC has decided (since 2006, solidifying their position in 1 FEB 2010) that if both petitions arrive at their office, from USCIS, together,

then that approved I-129F is gonna get administratively closed.

Sorry I dropped out for a bit. The times till visa are about the same, but the IR1/Cr1 is 9 months and the K3 is 10 months and $800 more. Since you are already married, the Cr1/ir1 path seems to make more sense since it has more benefit for less time (no Adjustment of status cost/hassle). By the time you are done with your I130, you'll be tired of dealing with our immigration!!!
