Hi, my petition was approved and I received the letter a week ago. Now I'm starting to file I-485 and have a few questions.

1. Medical examination:

--Can I get this done before filing the 485 by a immigration approved doctor or do I have to wait for uscis to tell me to go to their doctor?

--I do not have vaccination records, how do I go about this issue?

2. Affidavit of support

--My USC wife currently is unemployed, can I ask any other family member to file an affidavit of support (i.e. my mother-in-law)?

3. Advance Parole

--my father back in my home country is not doing too well health wise. I would like to visit him just in case he goes, is it advisable to file this while 485 is pending? is it safe to do it? should I wait for the 485 to be approved before leaving the country?

What are you adjusting from and do you have overstay in the USA.

Why didn't you file the I-130 and I-485 together at the same time as the guides state to. You must have the medical done by a CS listed from USCIS and send it in with the whole I-485 packet.

What are you adjusting from and do you have overstay in the USA.

Why didn't you file the I-130 and I-485 together at the same time as the guides state to. You must have the medical done by a CS listed from USCIS and send it in with the whole I-485 packet.

--did not file 485 concurrently because of financial reasons, in retrospect process would have been a lot faster, I'm married to USC petition, yes I over stayed.

1 You have to send medical report with I-485. If you don't, you will get RFE which will cause delays.

2 Your USC wife is your primary sponsor, employed or not. She has to fill out I-864. Co-sponsor also fills out the affidavit of support, in addition to your wife's.

3 It depends. What visa did you enter on and have you been out of status? If yes, for how long?

1. Technically you're supposed to get all your shots and medical forms filled out before you file for your i-485. The docter will give you a sealed envelope in which you have to send with the rest of your I-485 documents. Don't worry about not having any vaccination records. I didn't have any. I just took all the shots that were required for the I-693 Medical Form.

2. Your mother-in-law will have to fill out an I-864a. She will have to file as a co-sponsor which means she will need to meet 125% of the income requirements for 2 household members.

3. Yes, file the AP with your I-485. It will allow you to travel in and out of the country while your I-485 is in pending status.

--I have no status, I overstayed for a long time, I was 14 and came here on a child minor of a non-immigrant worker (H1B I believe), fast forward to now married a USC, been married for 4 years and trying to file I-485 with an approved petition. I just wanted to know what the steps and procedures to follow.

They are not filing from a spousal or fiance visa there for they need a FULL Medical done inside the USA to send with the I-485. Your advice is incorrect.

I already posted above the link to the CS locator for USCIS. YOu put your zipcode in and it tells you where to go. You go have your medical pay the medical fee and include the medical in the packet with the I-485.

Yes, you must include medical exam with I-485. Do not wait for RFE, send it with I-485.

And since you have been out of status for years, you should not leave the US until you have Green Card in hand. If you leave before you get GC, you will get a ban and won't be able to return, not even with AP.

You cannot use AP. If you apply for it, you will be approved, but if you leave the country you will have a ban and will not be able to reenter because you overstayed a long time. You can travel once you get the GC.

Your wife is the sponsor, and you can have a co-sponsor. The co-sponsor will fill out I-864 (NOT I-864a as stated above) and your wife will fill out I-864 as well.

5/23/12: Sent out package
2/06/13: APPROVED!
