I am the petioner who filed the I-130 form. My husband had his interview on May 13th. He didn't receive a denial for his Visa while at the embassy. He was told that they were sending the paperwork back to the U.S. He was told that USCIS would be contacting me to see if I wished to continue with the process. The paperwork was sent back to USCIS and received on June 29th. I received notification from them and was told the paperwork was being reviewed and that I would be contacted and informed when a decision was made or if they needed additional information from me. I have spoken to several people on this web site but would really like to communicate with someone that has had this happen to them. I would like to see if they could give me information on what to expect and if this is a common procedure.

ooops sorry about spelling error on petitioner!!!!

I am so sorry this has happened to you :(

We have seen it over and over again here on VJ, and quite often out of Kingston lately!

You can do a search for 221g and find many, many threads on the subject.

I have tried to find out more information for others and this is my understanding...

Basically the consular officer found something in the interview that made them question the validity of the relationship. Some have been scheduled for a second interview and requested the petitioner be there. In that instance the couple was seperated and asked the same questions to see if they have the same answers.

Take a look at this link, there is a brief list of reasons the case might be sent back:

http://www.ilw.com/a...0323-ellis.shtm

If you are requested to have another interview, please review this link before you go!

http://www.***removed***....-interview.html

There was a class action law suit that was recently thrown out of court and is now in appeal which you can read about here:

http://www.entrylaw....lassaction.html

quoted from the link above:

‎"the Doctrine of Consular Nonreviewability allows the State Department to charge U.S. citizen petitioners with fraud and not give them any opportunity to respond to the allegations."

:wow:

I pray things work out for you (F)

peace8 (F)

the last person I know who filed a K1 and had that happen, the USCIS finally sent them a letter saying the petition had expired and that there was no further action she could take!! :o

something must be done man... :(

We petition, pay all that money, suffer through the anxiety and survive the distance, and then you are misinformed, or not informed at all, and left to wonder until the expire date, and then made to file again, in my case unsuccessfully... :(

If ya'll knew my story.

somethings gonna give (L)
