HELP ME OUT!!!!

Timeline

So, I confirmed with JFK they do not give temporary EAD's anymore at the POE. So, I am researching the SS card process on the guides section of VJ. I find a document RM 002203.500 that states that a K-1 visa holder does not need an EAD from INS for permission to work. That the visa holder's I-94 (which I am assuming he gets at the POE ) is the work authorization and with that they are also able to apply for their SS card. Does anyone have experience with this? Please let me know....... Thanks! :)

Well according to one of the replies here http://www.visajourney.com/forums/index.php?showtopic=31750 a VJ'r came through JFK on Sept. 11th and got their Temp EAD ... so when did they stop issuing them?

I would also love to know if a K-1's I-94 is all that is required. I have been waiting here in San Diego for over 3 months for my EAD (NBC rec'd my I-131 June 8, 2006)

I somehow doubt that this is the case.

Could be a terminolgy issue.

I spoke to the actual Immigration and Customs office at the JFK airport, twice. because I know how unreliable taking someone's word is... I decided to wait until the afternoon and call again. Both ladies that answered the phone said they no longer do that anymore.

But what I'm most interested to know is as I was reading the guides on the SSN process I pulled up a memo that went out to all SSA offices saying that K-1 visa holders did not need that EAD for permission to work, their I-94 was the permission.

Do you know about this? Does anyone?

As a K-1 Visa holder you are entitled to be able to work for the 90 days from the date on your I-94 ... You need to apply for a SSN card (14 days after you arrive in the US) and when you get the SSN card it says something like " Work Authorization only with DHS approval " ...

However, the problem is that you have nothing to prove that you have approval for DHS to work as an employer will not accept just the I-94 as it doesn't say anywhere on it regarding work authorization ... And it is my understanding that everyone who enters the US on any kind of Visa receives an I-94 so that alone wouldn't make it clear to any employer ...

Not to mention you have to wait 14 days to apply for your SSN card then have to wait about 14 more days for it to arrive in the US which means you would probably be close to being in the US for about 30 days ... This would mean that you would only have 60 more days until your I-94 expires and would have to quit whatever job you are working at (although this is up to debate by many on VJ) until you receive your 1 year EAD ...

Personally, it kinda irritates me that the US government can't get this sorted out ... We are authorized to work for the 90 days but other departments in the US government don't know this ...

The easiest and obvious solution would be for All POEs to issue the temporary EAD stamp ...

Well, I would take the info you got with a grain of salt and go with recent experiences on the ground; they tend to be the most up to date.

The SSN info posted by mdyoung is absolutely up to the minute. K-1s are currently eligible to get a Social Security number in their first 76 days in the US with their passport and I-94. Full stop.

Getting hired for a job is an issue aside. To be hired, you must have *proof* of your EA on paper, and that is the stamped I-94. SSA will accept you as EA without the stamp; they are going to check your status with CIS so they do need the EAD. Employers are another story.

But get that SS# as soon as possible. It is useful for many, many things here.

The reason your post caught my eye is that there IS discussion at CIS now to NOT give K-1s that employment authorization *at all* until they file for AOS. I was wondering if that was already being put into place. You should most definitely prepare for that, and not count on being employed for your first 4-6 months in the US.

I think the important thing to know is what happens if you apply at SSA & are NOT found in SAVE. There are a couple of steps to take *at that point* to save yourself time and hassle. Actually I was told by the lady at the SSA that even if I was in the SAVE system that they can not issue you a SSN card unless your I-94 is 10 days or older ... She may have misunderstood the rules but I was lucky as I was there on my 10th day so I didn't have to argue with her ...

I had only been in the US for 6 days when I applied for my SSN...luckily I was in the SAVE system and had no problems at all.

Are you sure? I read that they don't offer interim EAD at the local office but I didn't think it will also affect getting a stamp at the POE. My fiance was planning going through JFK to get the work stamp, and not sure what to do now. Since he already had a SSN, we thought we had a chance to get EAD card before the Visa expires. Can anyone go through JFK recently verify this?

From what it looks like, one of the members actually went through on Sept. 11th and got the EAD stamp on their visa, so I would say yes... Unfortunatly my fiance has already booked his flight to Miami because we thought they were't dong that anymore.... :( Oh well, he'll just have to wait until he gets the authorization through the AOS...... volunteering here he comes! LOL
