Timeline

First of all I would like to thank everyone on this page for helping me out in the last past year. The good news is that my wife came to the US last Aug. Its been the best year of my life with Vanessa. Now it's time for me to start the paper work on our two kids. I did this before so I should know what to do but Im a little scared. I have a couple of questions. I should go the route of an IR-2 visa? Also, the childrens bio father is in Colombia. He never wanted to sign off custody to Vanessa to bring the kids over here. At the same time never helped out, it seems that he just never wanted to let go of his ex. They were never married, but his name is on the birth cert. He is currenty in jail for the next four years and said he will sign a permision for the kids to leave. As i understand Colombian law this needs to be presented to DAS near the date of departure. It seems like a gamble to start the paper work, and hope he signs off in nine months if they are givin the visa. My wife is doing paperwork with Beinestar Familair in Colombia for custody, but not sure what they are doing. They did say to start the process for the boys now. Do I need to send anything from the father with any of my packets? Sorry, it may seem like Im rambling, just don't want any REFs,

While I am not familiar with Colombian law, the father's permission for the children to immigrate to the US is not irrevocable. He can give his permission, then change it at any time before the children depart the country. If a parent changes his/her mind after given written permission, the US Embassy will not issue visas.

Go through this site, it's not uncommon to pay off the non-immigrating parent to allow the children to immigrate.

usually send in the permission with the DS-230 at NVC, during NVC document intake, but if you don't have it by then, is usually OK to present it on interview day.
