I-865 Past 3 years Tax Question

Hi there, I have all my ducks in a row sort of speak for after our wedding on August 6th. My question is this. I don't earn enough at my job so my sister who earns plenty is going to be our joint sponsor. We have all her information for her I-865 but for mine I cant get a hold of my tax transcript for the tax year of 2008 (my 3rd basically) due to the fact that it was filed by my ex husband jointly and he was head of household at the time (we were legally separated and I never even saw it just signed it when it went out the door). I tried to request it from the IRS but because it was a joint file and not in my SSN I couldn't get it. To answer ahead of time to get this information from my ex would be very difficult if not impossible. So my question is this. Since I don't earn enough in the first place and I have a joint sponser do you think if I notate on the third year something to that effect we would be ok or get an RFE? Any advice would be appreciated!

Three years of tax returns are not required. You have a choice to send three years if you want, or just the previous year's. Good luck.

We just had our interview and they only asked for 2010 tax returns. You should be ok with your co-sponser information along with what ever you provide to prove your status in 2010 which would confirm why you need a co-sponser. good luck!

Thank you for your reply, I know three years to send aren't required to physically send just the previous year but on the actual form it asks you to list the past three years income and for 2008 I don't have that information

We just had our interview and they only asked for 2010 tax returns. You should be ok with your co-sponser information along with what ever you provide to prove your status in 2010 which would confirm why you need a co-sponser. good luck!

The I-864, not i-865. The 865 is the address change form.

You are still able to get a copy of your tax return because you're on it. Don't know who you spoke to. I called to access our 2010 return and all they asked for was the SSN of my husband and of course his name. Possibly his birthday as well. There was no "you need him to get it". Try going INTO an office. It's YOUR return as well so there's no privacy concerns or you wouldn't have filed "jointly"

Vanessa is right, you should be able to get it but you will have to use something other than the automated system.

However, you should be fine without it. "Unavailable - joint filed with ex" should be a more than adequate explanation. Maybe estimate your individual income for that year, if relevant.

Actually, the income part is probably irrelevant, the only reason why you should try to contact the IRS and see if you can obtain it is because proof that you are a good citizen who files her taxes is relevant. If you don't know your ex's SSN someone at the IRS should still be able to access the record using your SSN, and if not they are dumb. Lol.

Vanessa and Joanna thanks for your replies, I feel a little better knowing that if I must, but we'll see, but if I must put unknown it wont grind to a halt my AOS.

Darnell, thanks for the link. I have used that link already before and did it already but I will call them today and see what they can tell me.

I just was very worried if I couldn't get it as I don't have his SSN. We will see

Oh and yes I meant i-864 as you all know. I don't know why i typed 865

Called today, answered a heck of a lot of security questions and was then told my gross income for 2008! Yay! Thanks again for everyone's assistance
