EB1-C Visa Question

Our appeal for an EB-1C multi-national manager petition was denied recently.

I'm not going to bore you with the details as I have a very specific question:

Lets suppose a parent company [Company X] in Country A decides to expand business to the United States:

Company X is a sole proprietorship and it forms a company in the United States as a S Corporation

So the foreign entity is a sole proprietorship and the company in the US is a S corporation

I was denied the petition, because the officer argued that inorder for there to be a qualifying relationship, the parent company must be a legal entity and a sole proprietorship is NOT a legal entity therefore no qualifying relationship can be established...

I want to know weather the officer was accurate?

If he was accurate: please give citations

If the officer was not accurate; PLEASE give me some case law, or citations that counter his claim

Yes the officer is correct. This just seems that you are trying to use the expanding of company as an easy excuse and under that pretext trying to immigrate to US
