My wife and I recently got married in the US. Unfortunately a family emergency surfaced and she had to return to Canada before we could start the AOS process. My question is, due to this unfortunate event will we have to do the CR-1 or would she be able to come back here and the we submit the AOS? I appreciate any and all advice.

Have to do CR-1.

If you enter and AOS its fraud and gives a life time ban from the USA.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Entering the US on a non-immigrant visa with intent to immigrate is fraud.

I would personally recommend filing the CR-1 BUT she can visit in the meantime, spend most of the waiting time with you if she likes, return for the medical and interview and then immigrate with her visa. Bearing in mind that as you are now married she will need to actually answer "visit my husband" and not "friend" because that COULD be held against her, and she will need to present strong ties to Canada. For this reason filing the CR-1 and then entering showing the NOA1 would be easier for her.

Thanks for your kind answers. We were hoping to have a little chance of doing AOS but considering the risks of it, we will

continue getting all the documents for our CR-1. We have almost all the documents for the I-130 now, i think we might be

able to send it in the first week of August and join the group of August 2011 filers :D

It is very speculative as to whether you will be able to enter the US after filing. Myy wife attempted to do so with all the docs necessary and they refused her entry. Not wanting to show multiple attempts to enter she has stayed in Canada since. so it is strictly up to the border agent, who may be having a bad day as to whether you may re-enter and spend time with your spouse while you await the visa. In many cases, you will not be permitted to enter.
