I dont understand when there is a per country limit set by rule formed in 1990, How can any country can be given more visa then 7%??? can anybody make me understand???look the DOS report...

it is clearly shown that dominic republic and mexico has been awarded more than 7% visas...can anybody explain me...

Read the Visa Bulletin.

75% of all F2a visas are exempt from the per country limit of 7%. In addition, all F2a from Mexico are exempt from the per country limit of 7%.

Take out the F2a exempt visas from Mexico and the total is less than 7%.

Take out the F2a exempt visa from the DR and total is more than 7%. In 2010, the DR was oversubscribed which resulted in the DR being add to the list of oversubscribed countries; China mainland born, Mexico, India, and the Philippines. If you look at the June 2010 Visa Bulletin, you will notice that the current PD for F2a for most countries is Jan 1, 2010, while the current PD for the DR is Jan 1, 2009. An attempt was make to reduce of people from the DR who were eligible for visas; push the current PD back resulted in fewer people with current PDs.

It can be very difficult to figure out precisely if a country will pass the 7% limit because it's impossible to know how many applicants will be granted visas. For example; if 3000 people are eligible to apply for visas - will you know how many will get visas and when???? Applicants have a year to file the DS-230 after their PDs become current. Some may not be eligible for visas. Of those 3000 people, can you or the US government guess how many will be get visas in 2010 with any accuracy (assume we are still in 2010 - you can not use hindsight)? Probably not. The best the US government can do is guess and try to reduce the number of people eligible to apply for visas.

Don't forget to be mad about Philippines and Vietnam too. They are over 8%.

Here is what I see. Much like the Google search algorithms and sausage making it's not easy to know exactly what's inside. There are per country allotments within worldwide allotments.

If a category has less "demand" worldwide then that may allow for some countries to exceed their 7% number ( Remove Mexico's F2A exempt number and it is at 4.2% overall). The worldwide allotment in the F2 exempt category was not used, so that allowed more visas in the other categories so that the total visa number (~226,000) was achieved.

Also, the derivative family members can impact the number for a country. A person eligible for a visa has a spouse and 3 kids that are eligible and get added in to the number for that country so that immediate families are not separated.

I am not sure though where they publish how many applicant there are for each country. If they follow 7% rule, there should cutoff date different for each country I believe.

Correct me guys if I am missing something..

i do agree with u..atleast maxico,philipines,dominic republic,india and chaina should have different cutoff date...
