Should I File for K3 or stick with CR1

Hi! I am just curious will doing the K3 help me or hurt me? I have already sent my I-130 now awaiting our NOA1 and can you all please advise me if I should send in the I-129F to file the K3 visa or just stick with the I-130? I want the way he gets to come here with me faster. So, what do you all think about all of this?

It's all the same at this point...one isnt necesarily faster than the other... but from what i've read the 129f is administratively closed as they no longer accept k3 visas but I could be wrong. If they do that then by the time you get to embassy level its a CR1 anyway...

CR1 is actually less expensive and they should get thier green card and SSN within a few weeks rather than waiting for the adjustment of status and another fee and possibly (not always) another interview and they don't have to wait for 3 months to get their SSN and begin working...

I've seen k3's take as much time as CR1... its basically a toss up...only thing is they do all the background checks prior to entry with CR1 (i'm sure they also do quite a bit with the k3 visa too just not sure that they do as much at the time of visa stamping)

and don't forget he's from pakistan so there is definitely going to be some real digging for background checks... very few men get out without ap if any...and the avg time it says is @4 months... those taking longer is due to hits on their names/fingerprints/or areas of work...

What happens is if the I-129F arrives at the NVC at the same time or after the I-130, the I-129F for K3 is administratively closed by the NVC. If the I-129F arrives at the NVC first, then the K3 will be processed (although in this instance, you could choose which visa to pursue).

OP: If you file the I-129F for K3, USCIS would pull your I-130 from it's current place in the queue and place it with the I-129F you would have just filed.

IMO, you are better off just sticking with the CR-1.

Yeah I wondered how that worked... that wasn't what we filed so I wasn't familiar with the whole procedure of k3. I just know that recently the k3 is taking as much time now as CR1 and is more $ in the end. Thanks for telling me how that works Ryan.. :thumbs:

IMO, you are better off just sticking with the CR-1.

Well, with that said on the queue part I am not bothering with the K3 then. I will just go on through with the I-130 stand alone. I already sent that off this weekend and it says that it will be delivered on Monday-God's willing. Any time-frame for receiving the NOA1? Also, what determines which processing center you are transferred to and how many are there that are currently processing I-130 applications? On the website for USCIS it says there are four of them.

Also, what determines which processing center you are transferred to and how many are there that are currently processing I-130 applications? On the website for USCIS it says there are four of them.

Only the service centers in California and Vermont adjudicate I-130's. I surmise that the biggest determining factor as to which one your file is sent to is the current load factor at one or the other. I also think your geographical location factors in as well but that would be secondary to load factor.
