Hello Everyone,

I am posting this once again in hopes that others in the same or similar situation can shed some light on this. So I married my husband, brought him and his son on k3/k4 visas. Apply for AOS in Sept 30th, 2010. Did Biometrics for both, received EAD and AP in early January for both and then everything comes to a grinding halt. When I go to the field office on a INFOPASS appointment. I am told it can take another 2 years before we even have an interview or get approved. After leaving very upset mind you, I got over it and put it out of my mind because that's just something I cant control. So then, on April 19th, I recieve an e-mail saying this:

Card/ Document Production

On April 19, 2011 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

If you do not receive your document, please contact our National Customer Service Center at 1-800-375-5283.

So, basically when you look at the timeline on the USCIS.gov site, all the dots on the line are empty except the card/production dot. We had NO interview after coming into the US, although we had one at the consulate in Dominican Republic, we received no welcome letter, no nothing. Its been 94 days and 67 business days and is now July 22nd, so way more than a calendar month has come and gone and nothing has come in the mail except the letters stating we have changed address to our new address and my husbands letter confirming change of address has a hand written note on the bottom with some sort of stamp in red saying approved on 4/19/2011. The actual GC has not arrived at the new or old address (my mother still lives at the old address). My step-sons has has no progress whatsoever even though my husbands says card production, my step-sons says no touch since Oct 2010 till this date. Has this happened to anyone else before or is it currently happening to anyone? Any responses will be greatly appreciated guys. The last person who responded to the post said they called and were told that no decision has been made in their case and that they are pending interview when they already had the interview a few months ago. I had no interview in difference from this person here in the States at all. I went to an info pass appointment and was told by the person that it was a mistake and we should be scheduled for an interview soon. I then called the national service center and the individual told me I was approved and that since its been past 30 days that I need to file for a replacement and told me what to mark to ensure that I don't need to pay for it. I filed that document end of May and last touch was June 5th, 2011 and still no response on that either way. Currently the field office handling our case is already processing for people who applied on Oct 19th, 2010 as of April 30th, 2011. I'm growing more and more scared that my husbands green card will not come in the mail and then we'll be stuck like so many other posts I read this evening waiting for years. I have set up another info pass appointment for the 26th of June to address this issue and hopefully get some clarification, until then I would appreciate feedback.Anyone in the same situation right now or a similar situation where they filed in Sept 2010 and have yet to have closure on their case? PLEASE HELP...

It sounds like you were approved, then the GC was lost in the mail. So you say you filed for a replacement card after that. That process can take several months. Who told you exactly that the email was an error?

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

The emial was an error came from the officer at the infopass appointment. But then that was also the person who told me that no one who comes on a marriage visa ever gets a approval without interview. With that being said, he said things that made no sense. That my husband shouldnt travel even if he had advances parole, etc etc.

I called the same day in the evening to the National Service Center and I was told that it was approved and since its been over 30 days that we should file for a replacement due to loss in part of USCIS.

Replacement cards are 6 months or more for processing.

I am also concerned with a second detail. If teh case is that we are approved. And the replacement can take up to 6 months, why has the joint application filed which is for my step son not been touched at all. Isnt that a joint approval if it was a joint application?

I would trust the NVC - K-3s can get approved without an interview - maybe the person you spoke with thought you did a concurrent I-130/I-485. I would be following the replacement GC and its progress - That's where you seem to be now. If you need more answers, consider contacting the immigration liason at you senator or congressman's office. Good luck.
