Hi...I'm a US Citizen and married a Canadian citizen in January '11 who is here on a TN. We have not yet filed for his AOS, trying to nail down a time when he doesn't have international business travel for three months. His minor children are here on summer visitation, on their Canadian passports. My 15 year old stepson is considering staying and going to school here. Can anyone let me know if we can apply for the TD under my husband's TN while he is already in the country on his passport or would he have to return home to Canada for us to do this? We're probably not going to be able to file for my husband's AOS until early next year. His TN is good until 9/2012.
