Express vs. Priority Mail for I-130/I-485

If we send today I think the Express Mail will require signature, and since its Saturday no one will be there.

If we send Priority it will get there Mon or Tues.

We are tight on time. If it gets there by Wed it will be 166 days overstay from B1/B2.

Priority seems like the right play since there will be someone there to sign as it will be during work week.

If anyone has a different suggestion pls let me know - thanks!

Time is not an issue here. Overstay is irrelevant/forgiven for spouses of US Citizens who adjust in country.

Sure but from an AP perspective, it seems like if I can get the NOA 1 before the 180 day mark she could travel abroad, no?

I personally wouldn't travel on AP with 170ish days of overstay anyway. She might not have an official ban, but it's cutting it pretty close... CBP always has discretion to deny entry.

Suggest not counting on any Advanced Parole, at all, based on the type of visa she held prior.

ie - wait till the green card is in hand.

re: postal type - I say priority.

Even if the packet gets there before day 180, there is no guarantee that NOA will be issued before 180th day. While it usually takes a few days to a couple of weeks, some people had to wait 30 days or more for NOA to be issued. I agree with other posters though, don't count on AP.

Prior visa shouldn't matter. We used AP with no issues. Excessive overstay is a different matter. Good luck.

I learned there are 2 checkboxes on the Express form:

1. do not deliver on weekends

2. do not deliver on holidays

I checked both. So it will get there by Monday noon. Best possible outcome.

I need to research how AP works in this situation but appreciate the advise.

Turning that packet over was pretty big. So many hours and so many decisions and then it just goes into an envelope and someone carries it away.

I am so curious to see how things turn out. I think know everything will be fine.

Wanted to close the loop on what the outcome was in case others search this content in the future.

While the package was sent USPS Express with the "do not delivery on weekend or holiday" checked, they attempted to deliver on a Saturday

The notice USPS gave on the online tracker was:

Notice Left (Business Closed CHICAGO IL 60605 07/23/11 11:46am )

I signed up for email notification on the USPS site, and that evening it was confirmed as delivered. It was a little behind in the updates.
