Hello,

I used the guide here for my wife's AOS package. I unfortunately used this link (http://www.visajourn...fees-in-effect/) for the fee and was rejected. I sent $1010.00 instead of $1070.00 which I believe now is the correct fee.

My question is about the EAD I-765 fee. On the instructions for that, it does not state that the fee is waived if filing with the I-485 for ©(9) applicants. But in the guide for AOS it stated we did not have to pay the $380 fee for the EAD if filed with the I-765 for K1-Visa entrants. Is that correct? Do I just send a single check for $1070 or one for $1070 and another for $385? We are not filing for the Advanced Parole.

Also, do i simply bundle up everything they sent back to me with the correct check(s) and send it back to them? Everything was opened, reorganized and stapled and some numbers on the sides of all the document pages that were subsequently crossed out with a pen.

Thank you! We don't want to delay another 3 weeks :)

The instructions DO say that the EAD fee is waived when filed in conjunction with I-485 - you just need to find it. You can just resend everything with a check for $1070.

USCIS website clearly states the fee of AOS. ALWAYS check the USCIS website !!!!

Put the correct fee in and send the entire thing back the way it was returned to you.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Remember, Visajourney is only a guide. You should always use the USCIS for anything that needs to be downloaded and is up to date.

And yes, the above posts are correct on the $1070 fee is included for the EAD.

Thank you all for confirming that. I just didn't want to have to wait another 3 weeks and see it back in our mail box again :) I know I was not smart in looking at the wrong fee table. After all the painstaking detail i took in the paperwork i want to kick myself for missing that one! I appreciate the help.

The fee for AP is also waived if filed together with the I-485. It certainly doesn't hurt to apply for it. Just another form, and it's not that hard.

One more question. When i send back everything they sent do i include the rejection letters or copies of them? Thanks!

It's not necessary. You're not responding to an RFE or submitting documents related to an existing petition case. This is a new application. When they see the numbers written on the documents they'll realize this is a petition package that was previously rejected. If they're really curious why it was previously rejected then they can look it up in their computer.
