hello to all , i am about to file my i-751 as a divorce waiver after almost two years of marriage .my divorce is not finalized yet and i am waiting for the divorce decree. please check if my evidence is OK for a divorce waiver( i think that a divorce waiver is scrutinized more than a joint application) . i would really appreciate your feedback .

1. form i-751.

2. check for $590.00 .

3. copy of green card front and back .

4. bank statement of our joint checking account for past 2 years.

5. IRS tax transcripts for 2009 and 2010.

6. copy of our apartment lease from last year.

7. copy of deed of our new house in both our names.

8. copy of our driver license .

9. copy of title of our car showing joint ownership.

10.copy of credit cards showing joint account with same credit card numbers.

11.copy of sample checks from our joint checking account.

12.copy of letter from IRS for first time home buyers tax credit.

13.copy of car insurance on both names.

14.copy of homeowners insurance on both names.

15.copy of life insurance policies.

16.copy of tickets of our trip to my home country.

17.copy of cell phone bills for last two years on both names on family plans.

18.copy of gas bill on both names covering 18 months.

19.copy of water bills on both names for 2 years.

20.copy of direct TV bills on my name but on the same address.

21.copy of internet bills on her name but at the same address.

22.Netflix account on both names.

23.our photos.

so do you guys think my evidence is good enough for a divorce waiver or is there anything that i need to add . i don't have any affidavits though and would that cause any problems .thanks in advance for reply.

You've got plenty!

Some of it is redundant - for example, no need to include statements AND sample checks from the same joint checking account.

No need to send ALL utility bills, you can send one for every 6 months or a year, as usually utility bills have up to a year of "history" on them anyway.

Lack of affidavits is not a problem - if USCIS decides to RFE you, you can send those, otherwise affidavits are not a necessity.

If you want to add something personal - see if you have any holiday cards addressed and mailed to both of you.

You've got plenty!

Some of it is redundant - for example, no need to include statements AND sample checks from the same joint checking account.

No need to send ALL utility bills, you can send one for every 6 months or a year, as usually utility bills have up to a year of "history" on them anyway.

Lack of affidavits is not a problem - if USCIS decides to RFE you, you can send those, otherwise affidavits are not a necessity.

thanks for the reply. what about my divorce waiver ? will my divorce cause a problem in the light of my evidence ?

You are correct in that divorce waiver I-751 are scrutinized more.

You are sending more evidence than I did and I got approved with no RFE or interview (also divorce waiver). You should be okay.

thanks for the reply. what about my divorce waiver ? will my divorce cause a problem in the light of my evidence ?
