Some background first...

My wife entered on a K-1, we submitted our I-485 and have our interview on 8/19/11. She received her EAD card today (YAY!).

Here are my questions:

~She is planning on going to the SS office tomorrow to apply for her SSN card. She has her passport, birth certificate, marriage certificate, EAD card and the SSN application filled out. Anything else she will need? Does the SSN office keep the originals and return them, or?

~She would like to get her Driver's License asap as well. Does she have to wait for her SSN card to arrive before applying for her DL in California? Or can she go to the DMV a few days after applying? It is my understanding that the DMV will check with the SS office's records electronically. Or is she ok since she now has her EAD card and this will suffice for a DL application? (Im gonna sift through the DMV website again to see if I can figure this one out, but any experience out there is appreciated).

EDIT: It appears she does need her SSN# when applying in California for her DL. Scratch that question! Thanks all.

She will also have to provide proof of legal presence and according to CA DMV website, EAD is acceptable proof of legal presence: http://dmv.ca.gov/dl/dl_info.htm#BDLP

She will also have to provide proof of legal presence and according to CA DMV website, EAD is acceptable proof of legal presence: http://dmv.ca.gov/dl/dl_info.htm#BDLP

Every state has different laws for driving license requirements. If she use's her EAD as proof of legal residence, her license very well may expire when her EAD expires, which only lasts for 1 year. Also some DMV's require a utility bill to show her address.

Hi Achillezz. I'm in California too. You will need both a SSN and proof of legal presence (the I-94 is not sufficient - they want proof of *permanent* legal presence). However, they do allow you to go and at least start the process - fill out the application forms, pay the application fees, take photograph, etc. They just won't actually issue the ID card itself until you mail in the SSN info and proper documentation. The good thing about this is that you get the number that will eventually be her ID card number. This is what we did with my husband, and I've found it's been very handy just to even have that number. Not sure if the EAD qualifies as the kind of documentation they require, but I'm sure they could let you know if you went in to the office to start the process.

11/05/2010 – Notified that background checks are not complete - looks like we're in for a looong wait...
12/07/2010 – Received email notification of NOA2
12/16/2010 – NVC sent the case to Embassy in Malawi
02/28/2011 – Interview
03/14/2011 – VISA APPROVED!
05/04/2011 – Fiance and I came back to the U.S. together! smile.png

07/06/2011 – Packet accepted.
07/07/2011 – Check cashed and NOA1 issued.
07/22/2011 – Received biometrics letter.

08/23/2011 – EAD Approved
08/31/2011 – EAD card arrived in the mail.
09/12/2011 – AOS interview - APPROVED! GC production ordered
09/21/2011 – Green Card received!!!

06/13/2013 - I-751 packet mailed to USCIS via certified return receipt.

06/17/2013 - NOA issued

06/19/2013 - Check cashed

06/21/2013 - Received NOA in mail.

06/26/2013 - Received biometrics letter.

07/02/2013 - Biometrics completed (walk-in)

11/18/2013 - APPROVED! Card production ordered

I should say, this has been our experience in applying for an *ID card* anyway - DL might be a little different...

Yes, I know that. OP is asking about California specifically and I replied accordingly. I even posted a couple of links from California DMV website, and if you click on them you will see that CA DMV accepts EAD as proof of legal presence. Californian DMV doesn't require a utility bill (again, see CA DMV website).
