Greetings to All VJ users !!!

Here s an issue i came across while filing I 130/I 485 Concurrently for my wife :

On I 864, Narrowing the options I have (considering the requirement of past 3-years tax transcript):

1. I, myself have tax transcript's wages n salaries (2010=12,840 2009= 6,886 2008= 7,480)due to the fact that I worked part time during my college. Now I am graduated and out of school, Hopefully the numbers would look better for coming tax period. so, my question: Is there any way i can deposit (the difference X 3 ) in my saving account now, and keep it till the process? does the asset's history matters?

2. The joint sponsor I have barely reach poverty level for 5 household including his wife's on & off jobs (2010= 33,861 2009= 29,963 2008= 8,487). He does meet the level on last year return but doesn't on previous 2 years. My concern is: does he need to meet that level on all past 3 years? does he need to provide his current pay stubs along with his tax transcript?? what other documents are mandatory from Joint sponsor??? if he is to mention assets i.e. his saving/checking balances, does he need bank letter???? bank statements?????

Any suggestion?? options?? plzzz help...Urgent !!!

Do you have a job now? What is the annualized income from that job ? That is what is important.

You are required to have filed taxes the last 3 years, and put the totals on the I-864 form. You must also list your current income, and provide proof of that income. Current income is what is really important, and must be above the 125% level. If it is not, then you can make up the difference with assets.

Do you have a job now? What is the annualized income from that job ? That is what is important.

yea I do have a job now which i started 3 months ago, My income would be around 50 k for this year tax income....but i didnt have much (see the numbers for 2010, 09 n 08)...thats why i am having problem !!! do you see any other options??

You are required to have filed taxes the last 3 years, and put the totals on the I-864 form. You must also list your current income, and provide proof of that income. Current income is what is really important, and must be above the 125% level. If it is not, then you can make up the difference with assets.

If you have employment now that is 50K you are fine. Past year's income is not relevant when you were in college. You shouldn't need a joint sponsor with the income you claim to earn.

Its your CURRENT income that matters. While your tax returns are required if you are NOW earning over the poverty threshold you should submit pay stubs and a letter from your employer and you should be fine.

my wife makes roughly the same thing you're making now, because she recently started work last fall, she got a letter from the employer to show that her income will go up at the end of the year. we still got a request for initial evidence (RFE form) lol. my sister helped me out and im sending the forms off tomorrow. just to be on a safe side, get someone else to co-sponsor for you. i dont know how much of a delay this will cause but at least everything has been worked out

WITH A CURRENT INCOME OF $50 K YOU SHOULD NOT NEED A JOINT SPONSOR !!!

You keep going on and on about the past tax returns, instead of focusing on your current income. You have a salary right now. That salary is what is counted as your current income. You put your current income on Part 6 #22, #23 and #24 of the I-864. You need to read through these replies to you. Someone that has a salary of 50k a year does not need a joint sponsor. Get a letter from your employer that states you work there and what your salary is. Send in that letter and a few recent pay stubs with your I-864. This is what counts and matters. Stop harping on the last 3 years not being enough. You said you make enough NOW, and that is all you need.

If you insist on using a joint sponsor anyway, it does not matter what their last 3 returns show either. It only matters what their current income is, and if they have proof of it. Past income tax returns are not proof of current income.
