i am sponsoring my husband's spousal visa, i read it here that HCMC consulate will ask for a list of beneficiary's relatives in the US and proof of residency. And we are having difficulties obtaining the copies of utility bills or drivers license from his relatives in the US. they are simply not cooperating! and worry sick that we will take advantage of their info! lol

SO here's my question, my dad works in the motor vehicle office, so its just one click away for him to pull out all of the relatives' information and have them printed out for me. I am not sure if I should tell my dad to do that. If you were me, would u tell your dad to do that ? any opinions are welcomed!

You can't ask him to do that. It's illegal (at least it would be in this state) for him to access those records for personal business.

Of course you can ask him BUT this would be illegal, unethical and could cost your father his job and legal issues. Btw, legal issues could be in any state.

If as he says it is public information and accessible by paying a fee then it should be ok to do as you suggest. A quick google or visit to the website of the dmv for your state will confirm this. Just to throw a monkey wrench in your plan though, A drivers license isn't necessarily proof of residency. Just that at one time the person lived at that address. I would double check that this is going to be adequate for the consulate.

and i assume it works just like credit/criminal history, finance company may pull up anyone's file to check before loaning money to people, or landlord check the tenant's credit/criminal history before renting ... i was trying to figure out the "illegal" issue with driving records, thanks

You just need the list. Proof of address isn't typically needed for the extended family. The proof of residency is more for ex-spouses and immediate family.

I agree.. Check that this would be sufficient. The driving record part (being public record) wouldn't present any problem (as long as they weren't given away for free against any DMV policy/law). But, the record alone wouldn't validate legal residency in the U.S. Only the documents presented to the DMV which did so (utility bill, SS card, GC, etc.) would and they (most certainly) are not part of the public record.

I actually read it to mean ask for the records behind the license, not a record of any tickets or infractions.

According to the information on this website, if you paid the fee and he printed you the driver history record it wouldn't include the information you are seeking.

You can request a copy of anyone's driving record but "sensitive information will be blocked off, such as the person's home address and social security number." When creditors, etc. check your record, don't forget...you've signed a document authorizing it. There is a difference.

I agree with the other posts, if it is for the visa process then it is a bit excessive to provide DMV print outs. Furthermore, this is not information that is "required". We were never asked to submit neither documents you are concerned about.
