Came here 8 Jan 2008

Married 29 Jan 2008

I came to visit and never left basically. No intent to stay what so ever but life got me by surprise.

How do I proof this?

I came here on VWP.

I had no work at the time and lived with my mother..

I did get a return ticket, but I deleted it from my inbox a long time ago , any other ways?

No I've never lied about it, no point.

But I'm just wondering because I've been reading a lot and a thing that I keep on reading is "as long as you didn't come here with the intent of getting married".

Now it sounds to me like it's a huge deal so they will probably ask at the interview.

Just thinking ahead here, I want to be fully prepared so nothing will go wrong.

Coming to the US with the intent of getting married is not a problem. Anyone could come to the US, marry, and then leave. Entering with a non-immigrant entry with the intention of immigrating is illegal unless that non-immigrant entry specifically allows for immigrant intent. The VWP does not allow for immigrant intent.

It might be a topic of discussion at your interview. They won't deny your adjustment of status based solely on preconceived intent. The worst case scenario would be if they had any evidence of preconceived intent, such as evidence of plans you made before arriving, and further evidence that you were asked about your intent by an immigration officer and denied any intention of immigrating, then they could accuse you of material misrepresentation. That would be serious enough to result in deportation and a potential lifetime ban from the US. This scenario is not very common, though. In order to determine whether you might be affected you'd need to think about what evidence might exist that they might know about and that might indicate a preconceived intent to immigrate, and whether you were specifically questioned about your intent when you arrived in the US.

You wouldn't have to actually lie about your intent. You'd only have to state that you didn't intend to immigrate when they had evidence to the contrary, even if the evidence didn't actually prove any intent to immigrate. The evidence could be as simple as bringing documents with you that would be required for adjustment of status but not normally required for a temporary visit to the US.

I got married on a Tourist Visa, then left, then came to visit my hubby almost a year after that and just couldnt keave. We had our interview today. The officer lady didnt even ask about it at all... Even thought i had papers about my work back home that i had to leave and what not.

08/2008- met in Baltimore. I was on J1. Started dating.
07/2009- I went back to England to finish my BA(Hons)
12/2009- he visits me in England and proposes on new years eve
04/2010- I visit him in Baltimore on B1/B2. We spontaneously get married. I leave to go back to England.
10/2010- he comes to meet my family in Russia. We have our "honey-week"
11/2010- I come to visit on B1/B2 again and he convinses me to stay
03/11/2011- sent out AOS
03/14/2011- package received
04/2011- RFE
05/2011- sent out response for RFE
07/08/2011- EAD card recieved
7/21/2011- Green Card interview success!

05/15/2013- ROC packet sent

06/26/2013- Biometrics

09/03/2013- Approved

09/10/2013- Card recived
