Going to file aos after 1 1/2 years since hubby got here

Hello! We are going to start doing the aos. Where can I find a sample filled out forms for Form I485. Also do we have to fill out I765, application for emplyment authorization? I read it's only good for 90 days. Please let me know.

Hello Everyone. Finally go reunited with my fiance and now husband. We are soo happy.... After 2 years since we filed 7/28/07 we received our visa on August 4, 2009... don't give up. if you know USEM is wrong fight for it... We did...

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

For Adjustment of status here are the forms that we will be fiiling out

Since we waited after 1 1/2 yr to file aos is there any other form(s) we need to fill out. Someone said I130. Is the I130 an additional payment aside from $1070? Becase the I130 it cost $420. Where did it say that we need to also file I-130?

Is it also necessary to file I765 work authorization because it says it's only good for 90 day starting the day you arrive to us and it will expire 90 days.

You do NOT need to file I-130.

The work authorization is good for a year, and it is free, but if your husband doesn't want to work while he waits for his Greencard, you don't need to apply for it.

For people reading this, a K-1 never needs to file a I-130, no matter how long they waited to file AOS. However, there is a law which states that K-1 adjusters will get a 2-year conditional Greencard when they AOS, no matter how long they have been married. Normally, if people have been married 2 years, they get a 10-year GC. Therefore, people on this forum often suggest that if it has been 2 years, that the person go ahead and file a I-130 as well, to make sure they get the 10-year GC. There have been people on this board who filed for AOS after being married after their K-1 for 3 years and they got the conditional GC. But, it is never a requirement.

In the OP's case, they have only been married 1.5 years, so there is no advantage to filing the I-130 and it is completely unnecessary. Good luck.

Nope, the fee is waived when filed in conjunction with the I-485. Read the instructions.

As Harpa stated it the fee is waived when filed together with the I-485. It says so in the instructions.

If their case isn't adjudicated BEFORE their second anniversary then they will wish they had filed an I-130 because by law USCIS can only issue a Conditional Greencard when someone AOSes based on a K-1 entry but if they've been married for 2 years then he can't be issued a conditional greencard so he will need an approved I-130 in order to adjust status.

Even if they're counting on AOS taking less than 6 months they might be better off waiting another few months and filing concurrently I-130 & i-485 to totally skip the conditional greencard and there fore not need to file for ROC in 2 years (which costs more than the I-130).

You're right that they might be better off waiting and filing with the I-130, but they CAN be issued a conditional greencard even if they have been married 2 years. Your statement that he cannot get a conditional greencard is incorrect. By the way, don't bother filling out I-131. He's been out of status for over a year so he will be banned if he leaves the country and won't be able to return with AP. He can't leave and return until he has GC in hand.
