How does my fiance go to school now that he has entered the states with his K-1 visa? I'm confused. Is he supposed to apply for another visa?

NO, wait for GC. He cannot get any other visa until he gets GC or withdraw K1. Apply for AOS ASAP.

Okay what is AOS sorry that I'm still newbie :) Does it mean adjustment of Status? We are no married yet (wedding is set on 8/9), can we apply right away ?

A K-1 is a NON-immigrant visa. He has no rights to work, to study, to travel, to do anything on his K-1 visa. Part of the process, is applying for his permanent residency, based on his approved K-1 visa and your subsequent marriage in the United States. This is called Adjustment of Status (AOS). I do hope you knew this going into the visa, and were just confused about the term AOS, because there is still a lot of immigration stuff to do for your fiance.

Thanks a lot for the reply and information. I did know what I was getting into (somewhat an idea) but it's all so confusing after the steps have taken so long for me.

I advise you not to do any thing with the K-1 visa. Get married and AOS. After that you can do what ever you want.

Do you know how long the process will take approximately? I think he will miss the new school semester :( Then will have to apply next year.

Otherwise, for a big uni, (with some exception) get the greencard.

Dont worry, it wont be that long :) As soon as you two marry, send in the Adjustment of Status.. After it's received by USCIS, it'll be about 3-6 months (probably closer to 4 than 6) until he gets his GC. Once he has that, he will be able to go to a "big league" university if he chooses to. So I guess he is looking at the January 2012 winter semester.

Just so you know, as soon as you send in your AOS package, he will have a Employment Authorization Card within 90 days (sometimes sooner than that) and he'll be able to take up employment wherever he wishes. So it's like he has to take one semester off to adjust status and work, then he's good to go for A LONG WHILE, once the GC come in.

The process may seem overwhelming, but it's not that bad. It's pretty straight foward once you know the drill. You're lucky you found this site, because anything that comes up, any question you have, we are all here and able to help you and guide you in the right direction :)

The K-1 is a non-immigrant visa. Your fiancee cannot attend school on a K-1 visa.

After you marry him, he can file for an adjustment of status based on his marriage to a US citizen. Once the adjust of status is granted and he becomes a legal permanent resident (green card holder), he can enroll in school.

On a related matter, he will likely have to pay out-of-state tuition during his first year of residency for college. Most colleges requires a student to have legally reside in the state for one year to qualify for in-state tuition.

I entered the US on a K1 Visa last Feb 2011. At the same time, I applied to grad school for this coming fall. They accepted me but also told me that I could not enroll without my GC. We filed AOS last April and it took 3 months for me to get the GC, so I am now good to go! You will probably have to wait for the Spring Semester now.. :) Goodluck!! :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Alla entered the US and started her masters degree five days later. There is no restriction about going to school on a federal level for the K-1. They are legally present in the US and have no restrictions regarding education. Any restrictions would be for state schools (residency requirements) or for federal student loans. You have to be a LPR to qualify for federal student loans/grants. Alla had a private scholarship from her private university in place before she arrived. We translated and had her educational creditials evaluated before she arrived and applied for a scholarship. She will graduate with a masters in teaching English on July 29, less than three years after arriving! :dance: I will be SOOOOOOOOOOOO glad when it is over! :lol:

Thats a school restriction, not a law. Schools can make their own rules.

I applied and got accepted to 3 schools and they all told me that I needed my GC, guess I picked the wrong schools then. I accepted the school that offered me a scholarship as well :) I can't wait! Congrats to your wife and to the OP goodluck and I hope you find a school that will let him study without a GC!

On a second note, does anyone have any idea if the junior colleges are GC required schools? He's trying to get into some missing classes before he applies to the graduate schools since the credit translation isn't the same, so he ended up lacking some units for lab + also missing speech for USA. :whistle:

The best way to check is to email the international students office of the school directly and ask.. like others have said, each school might have their own policies :) he also might need to have his transcripts validated by a company like WES ( world educ services)
